An act to amend Section 53115.1 of the Government Code, relating to state government.

SB 773, as amended, Skinner. Emergencies: State 911 Advisory Board.

The Warren-911-Emergency Assistance Act establishes the State 911 Advisory Board to advise the Office of Emergency Services on specified subjects relating to the state’s 911 emergency telephone response system and to conduct specified hearings on a final plan on implementation. Under existing law, the board is comprised of 11 members who are appointed by, and serve at the pleasure of, the Governor, including 2 representatives appointed on the recommendation of the California Police Chiefs Association, 2 representatives appointed on the recommendation of the California State Sheriffs’ Association, and 2 representatives appointed on the recommendation of the CalNENA Executive Board. Existing law also provides that members of the advisory board may not serve more than 2 consecutive 2-year terms except for (1) the presiding Chief of the California 911 Emergency Communications Office, who is required to serve for the duration of their tenure; and (2) 4 of the members who are required to serve an initial term of 3 years.

This bill, commencing on June 1, 2021, would revise membership on the advisory board by (1) reducing one representative appointed on the recommendation of the California Police Chiefs Association, one representative appointed on the recommendation of the California State Sheriffs’ Association, and one representative appointed on the recommendation of the CalNENA Executive Board, except that any member in those categories whose term began before June 1, 2021, may serve out their term as set forth in existing law at the pleasure of the Governor, and (2) adding one representative of the California Welfare Directors Association, one county public guardian, and one county mental health professional, all 3 of whom will serve at the pleasure of the Governor, as specified.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1.

It is the intent of the Legislature to enact legislation that would revise 911 systems so when an incident involves an issue of mental health, homelessness, and public welfare, the calls are directed to the appropriate social services agency and not to law enforcement.

SEC. 2.

Section 53115.1 of the Government Code is amended to read:

53115.1.

(a) There is in state government the State 911 Advisory Board.

(b) (1) Before June 1, 2021, the advisory board shall be comprised of the following members appointed by the Governor who shall serve at the pleasure of the Governor:

(A) The Chief of the Public Safety Communications Division shall serve as the nonvoting chair of the board.

(B) One representative from the Department of the California Highway Patrol.

(D) Two representatives on the recommendation of the California State Sheriffs’ Association.

(E) Two representatives on the recommendation of the California Fire Chiefs Association.

(F) Two representatives on the recommendation of the CalNENA Executive Board.

(G) One representative on the joint recommendation of the executive boards of the state chapters of the Association of Public-Safety Communications Officials-International, Inc.

(2) Commencing June 1, 2021, the advisory board shall be comprised of the following members appointed by the Governor who shall serve at the pleasure of the Governor:

(A) The Chief of the Public Safety Communications Division shall serve as the nonvoting chair of the board.

(B) One representative from the Department of the California Highway Patrol.

(C) One representative on the recommendation of the California Police Chiefs Association, except that any member so recommended whose term began before June 1, 2021, may serve out their term as set forth in subdivision (d) at the pleasure of the Governor.

(D) One representative on the recommendation of the California State Sheriffs’ Association, except that any member so recommended whose term began before June 1, 2021, may serve out their term as set forth in subdivision (d) at the pleasure of the Governor.

(E) Two representatives on the recommendation of the California Fire Chiefs Association.

(F) One representative on the recommendation of the CalNENA Executive Board, except that any member so recommended whose term began before June 1, 2021, may serve out their term as set forth in subdivision (d) at the pleasure of the Governor.

(G) One representative on the joint recommendation of the executive boards of the state chapters of the Association of Public-Safety Communications Officials-International, Inc.

(H) One representative of the California Welfare Directors Association.

(I) One county public guardian.

(J) One county mental health professional.

(c) Recommending authorities shall give great weight and consideration to the knowledge, training, and expertise of the appointee with respect to their experience within the California 911 system. Board members should have at least two years of experience as a Public Safety Answering Point (PSAP) manager or county coordinator, except where a specific person is designated as a member.

(d) Members of the advisory board shall serve at the pleasure of the Governor, but may not serve more than two consecutive two-year terms, except as follows:

(1) The presiding Chief of the Public Safety Communications Division shall serve for the duration of their tenure.

(2) Four of the members shall serve an initial term of three years.

(e) Advisory board members shall not receive compensation for their service on the board, but may be reimbursed for travel and per diem for time spent in attending meetings of the board.

(f) The advisory board shall meet quarterly in public sessions in accordance with the Bagley-Keene Open Meeting Act (Article 9 (commencing with Section 11120) of Chapter 2 of Part 1 of Division 3 of Title 2). The division shall provide administrative support to the State 911 Advisory Board. The State 911 Advisory Board, at its first meeting, shall adopt bylaws and operating procedures consistent with this article and establish committees as necessary.

(g) Notwithstanding any other provision of law, any member of the advisory board may designate a person to act as that member in their place and stead for all purposes, as though the member were personally present.
