{"id":131,"date":"2022-02-25T10:20:46","date_gmt":"2022-02-25T10:20:46","guid":{"rendered":"https:\/\/crowdsourcelawyers.com\/statutes-california-laws\/?page_id=131"},"modified":"2022-05-20T23:45:42","modified_gmt":"2022-05-20T23:45:42","slug":"probate-code-6110","status":"publish","type":"page","link":"https:\/\/crowdsourcelawyers.com\/california-statutes\/california-statutes\/probate-code-6110\/","title":{"rendered":"Probate Code 6110"},"content":{"rendered":"<section  class='av_textblock_section av-av_textblock-e878f05c31dff72941bf1e49a00d9ff5 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p>Currrent as of February 4, 2022<\/p>\n<\/div><\/section>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-l029kcbw-6d2c55b7a2355790a5c6e29481847104\">\n#top .av_textblock_section.av-l029kcbw-6d2c55b7a2355790a5c6e29481847104 .avia_textblock{\nfont-size:19px;\n}\n<\/style>\n<section  class='av_textblock_section av-l029kcbw-6d2c55b7a2355790a5c6e29481847104 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><h1>Probate Code \u00a7\u2002<span class=\"SS_prior SS_SH\">6110<\/span><\/h1>\n<h2 class=\"SS_Banner\">Witnessed will<\/h2>\n<hr \/>\n<p><strong>(a)<\/strong> Except as provided in this part, a will shall be in writing and satisfy the requirements of this section.<\/p>\n<p><strong>(b)<\/strong> The will shall be signed by one of the following:<\/p>\n<p style=\"padding-left: 40px\"><strong>(1)<\/strong> By the testator.<\/p>\n<p style=\"padding-left: 40px\"><strong>(2)<\/strong> In the testator\u2019s name by some other person in the testator\u2019s presence and by the testator\u2019s direction.<\/p>\n<p style=\"padding-left: 40px\"><strong>(3)<\/strong> By a conservator pursuant to a court order to make a will under Section 2580.<\/p>\n<p><strong>(c)<\/strong><\/p>\n<p style=\"padding-left: 40px\"><strong>(1)<\/strong> Except as provided in paragraph (2), the will shall be witnessed by being signed, during the testator\u2019s lifetime, by at least two persons each of whom (A) being present at the same time, witnessed either the signing of the will or the testator\u2019s acknowledgment of the signature or of the will and (B) understand that the instrument they sign is the testator\u2019s will.<\/p>\n<p style=\"padding-left: 40px\"><strong>(2)<\/strong> If a will was not executed in compliance with paragraph (1), the will shall be treated as if it was executed in compliance with that paragraph if the proponent of the will establishes by clear and convincing evidence that, at the time the testator signed the will, the testator intended the will to constitute the testator\u2019s will.<\/p>\n<hr \/>\n<p><strong>History<\/strong><\/p>\n<p>Enacted Stats 1990 ch 79 \u00a7 14 (AB 759), operative July 1, 1991.
