class='av_textblock_section av-l1bunfwy-644e4b8a4b834ed2b4efa6c768bb7203 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><h2>RTC \u00a7\u2002<span class=\"SS_SH SS_prior\">34010. <\/span>Definitions<\/h2>\n<p>For purposes of this part:<\/p>\n<p><strong>(a)<\/strong> \u201cArm\u2019s length transaction\u201d shall mean a sale entered into in good faith and for valuable consideration that reflects the fair market value in the open market between two informed and willing parties, neither under any compulsion to participate in the transaction.<\/p>\n<p><strong>(b)<\/strong> \u201cAverage market price\u201d shall mean both of the following:<\/p>\n<p style=\"padding-left: 40px;\">(1)<\/p>\n<p style=\"padding-left: 80px;\">(A) In an arm&#8217;s length transaction, the average retail price determined by the wholesale cost of the cannabis or cannabis products sold or transferred to a cannabis retailer, plus a mark-up, as determined by the department on a biannual basis in six-month intervals.<br \/>\n(B) Notwithstanding subparagraph (A), the department shall not increase the mark-up amount during the period beginning on and after the operative date of the act amending this section by adding this subparagraph and before July 1, 2021.<\/p>\n<p style=\"padding-left: 40px;\">(2) In a nonarm\u2019s length transaction, the cannabis retailer\u2019s gross receipts from the retail sale of the cannabis or cannabis products.<\/p>\n<p><strong>(c)<\/strong> \u201cDepartment\u201d means the California Department of Tax and Fee Administration or its successor agency.<\/p>\n<p><strong>(d)<\/strong> \u201cTax Fund\u201d means the California Cannabis Tax Fund created by Section 34018.<\/p>\n<p><strong>(e)<\/strong> \u201cCannabis\u201d has the same meaning as set forth in Section 11018 of the Health and Safety Code and shall also mean medicinal cannabis.<\/p>\n<p><strong>(f)<\/strong> \u201cCannabis products\u201d has the same meaning as set forth in Section 11018.1 of the Health and Safety Code and shall also mean medicinal concentrates and medicinal cannabis products.<\/p>\n<p><strong>(g)<\/strong> \u201cCannabis flowers\u201d means the dried flowers of the cannabis plant as defined by the board.<\/p>\n<p><strong>(h)<\/strong> \u201cCannabis leaves\u201d means all parts of the cannabis plant other than cannabis flowers that are sold or consumed.<\/p>\n<p><strong>(i)<\/strong> \u201cCannabis retailer\u201d means a person required to be licensed as a retailer, non-storefront retailer, microbusiness, or nonprofit pursuant to Division 10 (commencing with Section 26000) of the Business and Professions Code.<\/p>\n<p><strong>(j)<\/strong> \u201cCultivator\u201d means all persons required to be licensed to cultivate cannabis pursuant to Division 10 (commencing with Section 26000) of the Business and Professions Code.<\/p>\n<p><strong>(k)<\/strong> \u201cDistributor\u201d means a person required to be licensed as a distributor pursuant to Division 10 (commencing with Section 26000) of the Business and Professions Code.<\/p>\n<p><strong>(l)<\/strong> \u201cEnters the commercial market\u201d means cannabis or cannabis products, except for immature cannabis plants and seeds, that complete and comply with a quality assurance review and testing, as described in Section 26110 of the Business and Professions Code.<\/p>\n<p><strong>(m)<\/strong> \u201cGross receipts\u201d has the same meaning as set forth in Section 6012.<\/p>\n<p><strong>(n)<\/strong> \u201cMicrobusiness\u201d has the same meaning as set forth in paragraph (3) of subdivision (a) of Section 26070 of the Business and Professions Code.<\/p>\n<p><strong>(o)<\/strong> \u201cNonprofit\u201d has the same meaning as set forth in Section 26070.5 of the Business and Professions Code.<\/p>\n<p><strong>(p)<\/strong> \u201cPerson\u201d has the same meaning as set forth in Section 6005.<\/p>\n<p><strong>(q)<\/strong> \u201cRetail sale\u201d has the same meaning as set forth in Section 6007.<\/p>\n<p><strong>(r)<\/strong> \u201cSale\u201d and \u201cpurchase\u201d mean any change of title or possession, exchange, or barter, conditional or otherwise, in any manner or by any means whatsoever, for consideration.<\/p>\n<p><strong>(s)<\/strong> \u201cTransfer\u201d means to grant, convey, hand over, assign, sell, exchange, or barter, in any manner or by any means, with or without consideration.<\/p>\n<p><strong>(t)<\/strong> \u201cUnprocessed cannabis\u201d includes cannabis flowers, cannabis leaves, or other categories of harvested cannabis, categories for unprocessed or frozen cannabis or immature plants, or cannabis that is shipped directly to manufacturers.<\/p>\n<p><strong>(u)<\/strong> \u201cManufacturer\u201d means a person required to be licensed as a manufacturer pursuant to Division 10 (commencing with Section 26000) of the Business and Professions Code.<\/p>\n<p><strong>(v)<\/strong> \u201cMedicinal cannabis patient\u201d shall mean a qualified patient, as defined in Section 11362.7 of the Health and Safety Code, who possesses a physician\u2019s recommendation that complies with Article 25 (commencing with Section 2525) of Chapter 5 of Division 2 of the Business and Professions Code, or a qualified patient or primary caregiver for a qualified patient issued a valid identification card pursuant to Section 11362.71 of the Health and Safety Code.<\/p>\n<p><strong>(w)<\/strong> \u201cDesignated for donation\u201d shall mean medicinal cannabis donated by a cultivator to a cannabis retailer for subsequent donation to a medicinal cannabis patient pursuant to Section 26071 of the Business and Professions Code.<\/p>\n<hr \/>\n<p><strong>History<\/strong><\/p>\n<p>Adopted by voters, Prop. 64 \u00a7 7.1, effective November 9,
