Dymally-Alatorre Bilingual Services Act.<\/p>\n<p>Existing law, the Dymally-Alatorre Bilingual Services Act, requires that state agencies that serve a substantial number of non-English-speaking people employ a sufficient amount of bilingual persons in order to provide certain information and render certain services in a language other than English. The act\u00a0requires each state agency to conduct a survey of its local offices every 2 years regarding their public contact positions and the provision of bilingual services, as specified. The act requires the State Personnel Board to compile the results of the survey and provide it in a report to the Legislature every 2 years.<\/p>\n<p>This bill would revise and expand the duties of the State Personnel Board with regard to the surveys and implementation plans, and the report required to be submitted by the board. This bill would require state agencies to use specified criteria to determine whether the state agency serves a substantial\u00a0number of non-English-speaking people for purposes of the act.<\/p>\n<p>Vote:\u00a0majority\u00a0\u00a0\u00a0Appropriation:\u00a0no\u00a0\u00a0\u00a0Fiscal Committee:\u00a0yes\u00a0\u00a0\u00a0Local Program:\u00a0no<\/p>\n<hr \/>\n<p>THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:<\/p>\n<p><strong>SECTION 1.<\/strong><\/p>\n<p>Section 7296.2 of the Government Code is amended to read:<\/p>\n<p><strong>7296.2.<\/strong><\/p>\n<p>(a)\u00a0As applied to state agencies, a \u201csubstantial number of non-English-speaking people\u201d means members of a group who either do not speak English, or who are unable to effectively communicate in English because it is not their native language, and who comprise the lesser of the following:<\/p>\n<p>(1)\u00a0One thousand or more of the residents of a county in which the local office of a state agency is located.<\/p>\n<p>(2)\u00a0Five percent or more of the residents of a county in which the local office of a state agency is located<span style=\"text-decoration: line-through\">\u00a0in<\/span>.<\/p>\n<p>(3)\u00a0Five percent or more of the people served by any local office or facility of a state agency.<\/p>\n<p>(b)\u00a0In determining the substantial number of non-English-speaking people<span style=\"text-decoration: line-through\">\u00a0in<\/span>\u00a0for purposes of\u00a0paragraphs (1) and (2) of\u00a0subdivision (a), each state agency shall utilize the most accurate information\u00a0available\u00a0or data compiled by the United States Bureau of the Census or the Department of Finance relating to the language characteristics of the population. In the case of a local office of\u00a0a\u00a0state agency that services multiple counties, the determination\u00a0in paragraphs (1) and (2) of subdivision (a)\u00a0shall be based on the geographic service area of each local office.<\/p>\n<p><strong>SEC. 2.<\/strong><\/p>\n<p>Section 7299.6 of the Government Code is amended to read:<\/p>\n<p><strong>7299.6.<\/strong><\/p>\n<p>(a)\u00a0The State Personnel Board shall review the results of the surveys and implementation plans required to be made by Section 7299.4, to better inform the Legislature about the language needs of California residents and the available resources of state agencies to meet those needs. The State Personnel Board shall compile this data, and provide a report to the Legislature every two years.<\/p>\n<p>(b)\u00a0The report shall do all of the following:<\/p>\n<p>(1)\u00a0Identify state agencies that are not complying with this chapter.<\/p>\n<p>(2)\u00a0List state agencies and their respective field office or offices that have staffing deficiencies.<\/p>\n<p>(3)\u00a0List state agencies that have deficiencies in translated materials.<\/p>\n<p>(4)\u00a0Present key survey results and implementation plans by state agency and field office.<\/p>\n<p>(5)\u00a0Identify significant problems or deficiencies and propose solutions where warranted.<\/p>\n<p>(6)\u00a0Be submitted in compliance with Section 9795.<\/p>\n<hr \/>\n<p>Dymally Alatorre Bilingual Services Act<\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":3,"featured_media":0,"parent":2019,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-1795","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
