class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(a)\u2002The right to a trial by jury as declared by\u00a0<span class=\"cite\">Section 16 of Article I of the California Constitution\u00a0<\/span>shall be preserved to the parties inviolate. \u2002In civil cases, a jury may only be waived pursuant to subdivision (f).<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002<span class=\"added-material\">At least one<\/span>\u00a0party demanding a jury\u00a0<span class=\"added-material\">on each side of a civil case shall pay a nonrefundable fee of<\/span>\u00a0one hundred fifty dollars ($150)<span class=\"added-material\">, unless the fee has been paid by another<\/span>\u00a0party\u00a0<span class=\"added-material\">on the same side of the case. \u2002The fee shall offset the costs to the state of providing juries in civil cases. \u2002If there are more than two parties to the case, for purposes of this section only, all plaintiffs shall be considered one side of the case, and all other parties shall be considered the other side of the case. \u2002Payment of the fee by a party on one side of the case shall not relieve parties on the other side of the case from waiver pursuant to subdivision (f)<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002The\u00a0fee\u00a0<span class=\"added-material\">described in subdivision (b)<\/span>\u00a0shall be\u00a0<span class=\"added-material\">due<\/span>\u00a0on or before the date scheduled for the initial case management conference in the action<span class=\"added-material\">, except as follows:<\/span><\/p>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(1)\u2002In unlawful detainer actions, the fees shall be due at least five days before the date set for trial.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(2)<\/span>\u2002If no case management conference is scheduled in a civil action,\u00a0<span class=\"added-material\">or the initial case management conference occurred before June 28, 2012, and the initial complaint was filed on or after July 1, 2011, the fee<\/span>\u00a0shall be\u00a0<span class=\"added-material\">due<\/span>\u00a0no later than 365 calendar days after the filing of the initial complaint.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(3)\u2002If the initial case management conference occurred before June 28, 2012, and the initial complaint in the case was filed before July 1, 2011, the fee shall be due at least 25 calendar days before the date initially set for trial.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(4)<\/span>\u2002If the party\u00a0<span class=\"added-material\">requesting a jury<\/span>\u00a0has not appeared before the initial case management conference<span class=\"added-material\">,<\/span>\u00a0or\u00a0<span class=\"added-material\">first<\/span>\u00a0appeared more than 365 calendar days after the filing of the initial complaint, the\u00a0<span class=\"added-material\">fee<\/span>\u00a0shall be\u00a0<span class=\"added-material\">due<\/span>\u00a0at least 25 calendar days before the date initially set for trial.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(d)\u2002If a party failed to timely pay the fee described in subdivision (b) that was due between June 27, 2012, and November 30, 2012, the party will be relieved of a jury waiver on that basis only if the party pays the fee on or before December 31, 2012, or 25 calendar days before the date initially set for trial, whichever is earlier.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002The parties demanding a jury trial shall deposit with the clerk or judge, at the beginning of the second and each succeeding day&#8217;s session, a sum equal to that day&#8217;s fees and mileage of the jury, including the fees and mileage for the trial jury panel if the trial jury has not yet been selected and sworn. \u2002If more than one party has demanded a jury, the respective amount to be paid daily by each party demanding a jury shall be determined by stipulation of the parties or by order of the court.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(f)\u2002A party waives trial by jury in any of the following ways:<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002By failing to appear at the trial.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002By written consent filed with the clerk or judge.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(3)\u2002By oral consent, in open court, entered in the minutes.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(4)\u2002By failing to announce that a jury is required, at the time the cause is first set for trial, if it is set upon notice or stipulation, or within five days after notice of setting if it is set without notice or stipulation.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(5)\u2002By failing to\u00a0<span class=\"added-material\">timely pay the fee described<\/span>\u00a0in subdivision\u00a0<span class=\"added-material\">(b), unless another party on the same side of the case has paid that fee<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(6)\u2002By failing to deposit with the clerk or judge, at the beginning of the second and each succeeding day&#8217;s session, the sum provided in subdivision (e).<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(g)\u2002The court may, in its discretion upon just terms, allow a trial by jury although there may have been a waiver of a trial by jury.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(h)\u2002The court shall transmit the\u00a0<span class=\"added-material\">fee described in subdivision (b)<\/span>\u00a0to the State Treasury for deposit in the Trial Court Trust Fund within 45 calendar days after the end of the month in which the\u00a0<span class=\"added-material\">fee is paid to<\/span>\u00a0the court.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a
