class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(a)\u2002In the case of any realty held by a partnership\u00a0<span class=\"added-material\">or other entity treated as a partnership for federal income tax purposes<\/span>, no levy shall be imposed pursuant to this part by reason of any transfer of an interest in\u00a0<span class=\"added-material\">the<\/span>\u00a0partnership or\u00a0<span class=\"added-material\">other entity or<\/span>\u00a0otherwise, if\u00a0<span class=\"added-material\">both of the following occur:<\/span><\/p>\n<div class=\"subsection\">\n<p>(1)\u2002<span class=\"added-material\">The<\/span>\u00a0partnership\u00a0<span class=\"added-material\">or other entity treated as a<\/span>\u00a0partnership\u00a0is considered a continuing partnership within the meaning of\u00a0<span class=\"cite\">Section 708 of the Internal Revenue Code\u00a0<\/span>of\u00a0<span class=\"added-material\">1986.<\/span>\u2009\u00a0<span class=\"footnote-reference\">\u20091<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002<span class=\"added-material\">The<\/span>\u00a0continuing partnership\u00a0<span class=\"added-material\">or other entity treated as a partnership<\/span>\u00a0continues to hold the realty concerned.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002If there is a termination of any partnership\u00a0<span class=\"added-material\">or other entity treated as a partnership for federal income tax purposes,<\/span>\u00a0within the meaning of\u00a0<span class=\"cite\">Section 708 of the Internal Revenue Code of 1986\u00a0<\/span>, for purposes of this part,\u00a0<span class=\"added-material\">the<\/span>\u00a0partnership\u00a0<span class=\"added-material\">or other entity<\/span>\u00a0shall be treated as having executed an instrument whereby there was conveyed, for fair market value (exclusive of the value of any lien or encumbrance remaining thereon), all realty held by\u00a0<span class=\"added-material\">the<\/span>\u00a0partnership\u00a0<span class=\"added-material\">or other entity<\/span>\u00a0at the time of\u00a0<span class=\"added-material\">the<\/span>\u00a0termination.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002Not more than one tax shall be imposed pursuant to this part by a county, city and county or city by reason of a termination described in subdivision (b), and any transfer pursuant thereto, with respect to the realty held by\u00a0<span class=\"added-material\">a partnership or other entity treated as a<\/span>\u00a0partnership at the time of\u00a0<span class=\"added-material\">the<\/span>\u00a0termination.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(d)\u2002No levy shall be imposed pursuant to this part by reason of any transfer between an individual or individuals and a legal entity or between legal entities that results solely in a change in the method of holding title to the realty and in which proportional ownership interests in the realty, whether represented by stock, membership interest, partnership interest, cotenancy interest, or otherwise, directly or indirectly, remain the same immediately after the transfer.<\/span><\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a
