class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(a)\u2002If, in the opinion of the\u00a0<span class=\"added-material\">Secretary of the Department<\/span>\u00a0of Corrections\u00a0<span class=\"added-material\">and Rehabilitation<\/span>, the rehabilitation of any mentally ill, mentally deficient, or insane person confined in a state prison may be expedited by treatment at any one of the state hospitals under the jurisdiction of the State Department of\u00a0<span class=\"added-material\">State Hospitals<\/span>\u00a0or the State Department of Developmental Services, the\u00a0<span class=\"added-material\">Secretary of the Department<\/span>\u00a0of Corrections\u00a0<span class=\"added-material\">and Rehabilitation<\/span>, with the approval of the Board of\u00a0<span class=\"added-material\">Parole Hearings<\/span>\u00a0for persons sentenced pursuant to\u00a0<span class=\"cite\">subdivision (b) of Section 1168\u00a0<\/span>, shall certify that fact to the director of the appropriate department who shall evaluate the prisoner to determine if he or she would benefit from care and treatment in a state hospital. \u2002If the director of the appropriate department so determines, the superintendent of the hospital shall receive the prisoner and keep him or her until in the opinion of the superintendent the person has been treated to the extent that he or she will not benefit from further care and treatment in the state hospital.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002Whenever the\u00a0<span class=\"added-material\">Secretary of the Department<\/span>\u00a0of Corrections\u00a0<span class=\"added-material\">and Rehabilitation<\/span>\u00a0receives a recommendation from the court that a defendant convicted of a violation of\u00a0<span class=\"cite\">Section 646.9\u00a0<\/span>and sentenced to confinement in the state prison would benefit from treatment in a state hospital pursuant to subdivision (a), the\u00a0<span class=\"added-material\">secretary<\/span>\u00a0shall consider the recommendation. \u2002If appropriate, the\u00a0<span class=\"added-material\">secretary<\/span>\u00a0shall certify that the rehabilitation of the defendant may be expedited by treatment in a state hospital and
