class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(a)\u2002<span class=\"added-material\">A trust may be modified or terminated by<\/span>\u00a0the\u00a0<span class=\"added-material\">written consent of the<\/span>\u00a0settlor and all beneficiaries\u00a0<span class=\"added-material\">without court approval of<\/span>\u00a0the modification or termination.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002If any beneficiary does not consent to the modification or termination of the trust,\u00a0<span class=\"added-material\">the court may modify or partially terminate the trust<\/span>\u00a0upon petition to the court\u00a0<span class=\"added-material\">by<\/span>\u00a0the other beneficiaries, with the consent of the settlor,\u00a0if the interests of the beneficiaries who do not consent are not substantially impaired.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002If the trust provides for the disposition of principal to a class of persons described only as \u201cheirs\u201d or \u201cnext of kin\u201d of the settlor, or using other words that describe the class of all persons who would take under the rules of intestacy, the court may limit the class of beneficiaries whose consent is\u00a0<span class=\"added-material\">necessary to modify or terminate a<\/span>\u00a0trust to the beneficiaries who are reasonably likely to take under the circumstances.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a
