class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(a)<\/span>\u2002To select a fair and impartial jury in\u00a0<span class=\"added-material\">a<\/span>\u00a0civil jury\u00a0<span class=\"added-material\">trial<\/span>, the trial judge shall\u00a0<span class=\"added-material\">conduct an initial examination of<\/span>\u00a0prospective jurors. \u2002<span class=\"added-material\">At the final status conference or at the first practical opportunity prior to voir dire, whichever comes first, the trial judge shall consider and discuss with counsel the form and subject matter of voir dire questions. \u2002Before voir dire by the trial judge, the parties may submit questions to the trial judge. \u2002The trial judge may include additional questions requested by the parties as the trial judge deems proper.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(b)(1)<\/span>\u2002Upon completion of the\u00a0<span class=\"added-material\">trial<\/span>\u00a0judge&#8217;s initial examination, counsel for each party shall have the right to examine, by oral and direct questioning, any of the prospective jurors in order to enable counsel to intelligently exercise both peremptory challenges and challenges for cause. \u2002<span class=\"added-material\">The scope of the examination conducted by counsel shall be within reasonable limits prescribed by the trial judge in the judge&#8217;s sound discretion subject to the provisions of this chapter.<\/span>\u00a0\u2002During any examination conducted by counsel for the parties, the trial judge\u00a0<span class=\"added-material\">shall<\/span>\u00a0permit liberal and probing examination calculated to discover bias or prejudice with regard to the circumstances of the particular case\u00a0<span class=\"added-material\">before the court<\/span>. \u2002The fact that a topic has been included in the\u00a0<span class=\"added-material\">trial<\/span>\u00a0judge&#8217;s examination\u00a0<span class=\"added-material\">shall<\/span>\u00a0not preclude\u00a0<span class=\"added-material\">appropriate followup<\/span>\u00a0questioning in the same area by counsel. \u2002<span class=\"added-material\">The trial judge shall permit counsel to conduct voir dire examination without requiring prior submission of the questions unless a particular counsel engages in improper questioning.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(2)\u2002The trial judge shall not impose specific unreasonable or arbitrary time limits or establish an inflexible time limit policy for voir dire.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(3)\u2002For purposes of this section, an \u201c<span class=\"wordphrase\">improper question<\/span>\u201d is any question that, as its dominant purpose, attempts to precondition the prospective jurors to a particular result, indoctrinate the jury, or question the prospective jurors concerning the pleadings or the applicable law.<\/span><\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(c)(1)<\/span>\u2002In exercising\u00a0<span class=\"added-material\">the judge&#8217;s<\/span>\u00a0sound discretion<span class=\"added-material\">, the trial judge shall give due consideration to all of the following:<\/span><\/p>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(A)\u2002The amount of time requested by trial counsel.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(B)\u2002Any<\/span>\u00a0unique or complex elements, legal or factual, in the case<span class=\"added-material\">.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(C)\u2002Length of the trial.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(D)\u2002Number of parties.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(E)\u2002Number of witnesses.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(F)\u2002Whether the case is designated as a complex or long cause.<\/span><\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(2)\u2002As voir dire proceeds, the judge shall permit supplemental time for questioning based on any of the following:<\/span><\/p>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(A)\u2002Individual<\/span>\u00a0responses or conduct of jurors\u00a0<span class=\"added-material\">that<\/span>\u00a0may evince attitudes inconsistent with suitability to serve as a fair and impartial juror in the particular case.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(B)\u2002Composition of the jury panel.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(C)\u2002An unusual number of for cause challenges.<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(d)\u2002Upon the request of a party, the trial judge shall allow a brief opening statement by counsel for each party prior to the commencement of the oral questioning phase of the voir dire process.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(e)\u2002In civil cases, the trial judge may, upon stipulation by counsel for all the parties appearing in the action, permit counsel to examine the prospective jurors outside a judge&#8217;s presence.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(f)\u2002A<\/span>\u00a0trial judge\u00a0shall not arbitrarily or unreasonably refuse to submit reasonable written questionnaires, the contents of which are determined by the court in its sound discretion, when requested by counsel. \u2002If a questionnaire is utilized, the parties\u00a0<span class=\"added-material\">shall<\/span>\u00a0be given reasonable time to evaluate the responses to the questionnaires before oral questioning commences.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(g)<\/span>\u2002To help facilitate the jury selection process<span class=\"added-material\">, at the earliest practical time<\/span>, the judge in\u00a0<span class=\"added-material\">a<\/span>\u00a0civil\u00a0<span class=\"added-material\">trial shall<\/span>\u00a0provide the parties with both the alphabetical list and the list of prospective jurors in the order in which they will be called.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a
