class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(a)\u2002No prepaid health plan, marketing representative, or marketing organization shall in any manner misrepresent itself, the plans it represents, or the Medi-Cal program or\u00a0<span class=\"added-material\">the<\/span>\u00a0Healthy Families Program. \u2002Violations of this section shall include, but are not limited to:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002False or misleading claims that marketing representatives are employees or representatives of the state, county, or anyone other than the prepaid health plan or the organization by whom they are reimbursed.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002False or misleading claims that the prepaid health plan is recommended or endorsed by any state or county agency, or by any other organization which has not certified its endorsement in writing to the prepaid health plan.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(3)\u2002False or misleading claims that the state or county recommends that a Medi-Cal beneficiary enroll in a prepaid health plan.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(4)\u2002Claims that a Medi-Cal beneficiary will lose his\u00a0<span class=\"added-material\">or her<\/span>\u00a0benefits under the Medi-Cal program or any other health or welfare benefits to which he\u00a0<span class=\"added-material\">or she<\/span>\u00a0is legally entitled, if he\u00a0<span class=\"added-material\">or she<\/span>\u00a0does not enroll in a prepaid health plan.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002Violations of this article or regulations adopted by the department pursuant to this article shall result in one or more of the following sanctions that are appropriate to the specific violation, considering the nature of the offense and frequency of occurrence within the prepaid health plan:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002Revocation of one or more permitted methods of marketing.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002Termination of authorization for a plan to provide application assistance.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(3)\u2002Refusal of the department to accept new enrollments for a period specified by the department.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(4)\u2002Refusal of the department to accept enrollments submitted by a marketing representative or organization.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(5)\u2002Forfeiture by the plan of all or part of the capitation payments for persons enrolled as a result of such violations.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(6)\u2002Requirement that the prepaid health plan in violation of this article personally contact each enrollee enrolled to explain the nature of the violation and inform the enrollee of his\u00a0<span class=\"added-material\">or her<\/span>\u00a0right to disenroll.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(7)\u2002Application of sanctions as provided in\u00a0<span class=\"cite\">Section 14304\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(8)\u2002Temporarily\u00a0<span class=\"added-material\">suspend<\/span>\u00a0capitation payments for beneficiaries enrolled in violation of this article, or regulations adopted thereunder, until the prepaid health plan is in substantial compliance with the statutory and regulatory provisions.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002Any marketing representative who violates subdivision (a) while engaged in door-to-door solicitation is guilty of a misdemeanor, and shall be subject to a fine of five hundred dollars ($500) or imprisonment in\u00a0<span class=\"added-material\">a<\/span>\u00a0county jail for six months, or both.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a
