class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(a)\u2002A landlord of a dwelling may not demand rent, collect rent, issue a notice of a rent increase, or issue a three-day notice to pay rent or quit pursuant to\u00a0<span class=\"cite\">subdivision (2) of Section 1161 of the Code of Civil Procedure\u00a0<\/span>, if all of the following conditions exist prior to the landlord&#8217;s demand or notice:<\/span><\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002The\u00a0dwelling substantially lacks any of the affirmative standard characteristics listed in\u00a0<span class=\"cite\">Section 1941.1\u00a0<\/span><span class=\"added-material\">or violates\u00a0<span class=\"cite\">Section 17920.10 of the Health and Safety Code\u00a0<\/span>, or is deemed and declared substandard as set forth in\u00a0<span class=\"cite\">Section 17920.3 of the Health and Safety Code\u00a0<\/span>because conditions listed in that section exist to an extent that endangers the life, limb, health, property, safety, or welfare of the public or the occupants of the dwelling<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002A public officer or employee who is responsible for the enforcement of any housing law<span class=\"added-material\">, after inspecting the premises,<\/span>\u00a0has notified the landlord\u00a0<span class=\"added-material\">or the landlord&#8217;s agent in writing<\/span>\u00a0of his or her obligations to abate the nuisance or repair the substandard conditions.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(3)\u2002The conditions have existed and have not been abated\u00a0<span class=\"added-material\">35<\/span>\u00a0days beyond the date of\u00a0<span class=\"added-material\">service<\/span>\u00a0of the notice specified in paragraph (2) and the delay is without good cause. \u2002<span class=\"added-material\">For purposes of this subdivision, service shall be complete at the time of deposit in the United States mail.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(4)\u2002The conditions were not caused by an act or omission of the tenant or lessee in violation of\u00a0<span class=\"cite\">Section 1929\u00a0<\/span>or\u00a0<span class=\"cite\">1941.2\u00a0<\/span>.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(b)(1)\u2002A landlord who violates this section is liable to the tenant or lessee for the actual damages sustained by the tenant or lessee and special damages of not less than one hundred dollars ($100) and not more than five thousand dollars ($5,000).<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(2)\u2002T<\/span>he prevailing party shall be entitled to recovery of reasonable attorney&#8217;s fees\u00a0<span class=\"added-material\">and costs of the suit<\/span>\u00a0in an amount fixed by the court.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002Any court that awards damages under\u00a0<span class=\"added-material\">this section<\/span>\u00a0may also order the landlord to abate any nuisance at the rental dwelling and to repair any substandard conditions of the rental dwelling, as defined in\u00a0<span class=\"cite\">Section 1941.1\u00a0<\/span>, which significantly or materially affect the health or safety of the occupants of the rental dwelling and are uncorrected. \u2002If the court orders repairs or corrections, or both, the court&#8217;s jurisdiction continues over the matter for the purpose of ensuring compliance.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002The tenant or lessee shall be under no obligation to undertake any other remedy prior to exercising his or her rights under this section.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002Any action under this section may be maintained in small claims court if the claim does not exceed the jurisdictional limit of that court.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(f)\u2002The remedy provided by this section\u00a0may be utilized in addition to any other remedy provided by this chapter, the rental agreement, lease, or other applicable statutory or common law. \u2002Nothing in this section shall require any landlord to comply with this section if he or she pursues his or her rights pursuant to Chapter 12.75 (commencing with\u00a0<span class=\"cite\">Section 7060) of Division 7 of Title 1 of the Government Code\u00a0<\/span>.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br
