class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(a)\u2002Except as provided in subdivision (b), an employer reemploying a participant with service subject to the requirements of Chapter 43 (commencing with\u00a0<span class=\"cite\">Section 4301\u00a0<\/span>) of Title 38 of the United States Code, shall be liable to remit the employer contributions provided that employer employed the participant immediately prior to the eligible period of service in the uniformed services. \u2002<span class=\"added-material\">The<\/span>\u00a0contribution rate by the employer shall be to the same extent as that for contributions to the Cash Balance Benefit Program for other employees during the same period. \u2002<span class=\"added-material\">In addition to contributions due pursuant to this subdivision, the employer shall remit an amount that is the equivalent of the full cost of any interest and additional earnings credits credited pursuant to\u00a0<span class=\"cite\">Section 28001\u00a0<\/span>.<\/span>\u00a0\u2002The employer shall\u00a0provide information\u00a0<span class=\"added-material\">regarding<\/span>\u00a0the\u00a0<span class=\"added-material\">reemployment of a participant who is subject to Chapter 43 (commencing with\u00a0<span class=\"cite\">Section 4301\u00a0<\/span>) of Title 38 of the United States Code<\/span>\u00a0on a form\u00a0<span class=\"added-material\">prescribed<\/span>\u00a0by the system\u00a0<span class=\"added-material\">within 30 days of<\/span>\u00a0the\u00a0<span class=\"added-material\">date<\/span>\u00a0of reemployment. \u2002Following receipt of that notice, the system shall calculate in accordance with\u00a0<span class=\"cite\">Section 28003\u00a0<\/span>the total amount of employer contributions due for the participant for the full period of service in the uniformed services. \u2002Within 60 working days of notification by the plan of amount due, the employer shall remit to the plan all employer contributions.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002The employer shall not be liable for employer contributions for the period of service in the uniformed services if the participant elects not to remit the employee contributions for that period through the employer as required under\u00a0<span class=\"cite\">Section 28001\u00a0<\/span>. \u2002In the event the participant does not remit all of the employee contributions within the prescribed repayment period, the total amount of the employer contributions\u00a0<span class=\"added-material\">that were remitted for that period<\/span>\u00a0shall\u00a0<span class=\"added-material\">be adjusted pursuant<\/span>\u00a0to\u00a0<span class=\"added-material\"><span class=\"cite\">Section 26302\u00a0<\/span><\/span>.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr
