class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(a)(1)\u2002A person shall not<\/span>\u00a0willfully or negligently\u00a0<span class=\"added-material\">cut, destroy, mutilate, or remove plant material that is<\/span>\u00a0growing upon state or county highway rights-of-way<span class=\"added-material\">.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(2)\u2002A person shall not<\/span>\u00a0willfully or negligently\u00a0<span class=\"added-material\">cut, destroy, mutilate, or remove plant material that is<\/span>\u00a0growing upon public land or upon land\u00a0<span class=\"added-material\">that is<\/span>\u00a0not his or\u00a0<span class=\"added-material\">hers<\/span>\u00a0without\u00a0<span class=\"added-material\">a<\/span>\u00a0written permit from the owner of the land<span class=\"added-material\">,<\/span>\u00a0signed by the owner\u00a0<span class=\"added-material\">of the land<\/span>\u00a0or the owner&#8217;s authorized agent,\u00a0<span class=\"added-material\">as provided in subdivision (c)<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(3)\u2002A person shall not knowingly sell, offer or expose for sale, or transport for sale plant material that is cut or removed in violation of this subdivision.<\/span><\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(b)\u2002For purposes of this section, \u201c<span class=\"wordphrase\">plant material<\/span>\u201d means a tree, shrub, fern, herb, bulb, cactus, flower, huckleberry, or redwood green, or a portion of any of those, or the leaf mold on those plants. \u2002\u201cPlant material\u201d does not include a tree, shrub, fern, herb, bulb, cactus, flower, or greens declared by law to be a public nuisance.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(c)(1)<\/span>\u2002The written permit required\u00a0<span class=\"added-material\">by paragraph (2) of subdivision (a)<\/span>\u00a0shall be signed by the landowner, or the landowner&#8217;s authorized agent, and acknowledged before a notary public, or other person authorized by law to take acknowledgments. \u2002The permit shall contain the number and species of trees and amount of\u00a0<span class=\"added-material\">plant material<\/span>, and shall contain the legal description of the real property as usually found in deeds and conveyances of the land on which cutting or removal\u00a0shall take place. \u2002One copy of the permit shall be filed in the office of the sheriff of the county in which the land described in the permit is located. \u2002The permit shall be filed prior to\u00a0<span class=\"added-material\">the<\/span>\u00a0commencement of cutting\u00a0<span class=\"added-material\">or removal of plant material<\/span>\u00a0authorized by the permit.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(2)<\/span>\u2002The permit required by this section need not be notarized or filed with the\u00a0sheriff\u00a0when five or less\u00a0pounds of shrubs or boughs are to be cut or removed.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(d)\u2002A<\/span>\u00a0county or state fire warden<span class=\"added-material\">;<\/span>\u00a0personnel of the Department of Forestry and Fire Protection<span class=\"added-material\">,<\/span>\u00a0as designated by the Director of Forestry and Fire Protection<span class=\"added-material\">;<\/span>\u00a0personnel of the United States Forest Service<span class=\"added-material\">,<\/span>\u00a0as designated by the Regional Forester, Region 5, of the United States Forest Service<span class=\"added-material\">;<\/span>\u00a0or\u00a0<span class=\"added-material\">a<\/span>\u00a0peace officer of the State of California, may enforce the provisions of this section and may confiscate any and all\u00a0<span class=\"added-material\">plant material<\/span>\u00a0unlawfully cut or removed or knowingly sold, offered, or exposed or transported for sale as provided in this section.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(e)<\/span>\u2002This section does not apply to any\u00a0<span class=\"added-material\">of the following:<\/span><\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(1)\u2002An employee of the state or of a political subdivision of the state who is engaged in work upon a state, county, or public road or highway while performing work under the supervision of the state or a political subdivision of the state.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(2)\u2002A person engaged in<\/span>\u00a0the necessary cutting or trimming of\u00a0<span class=\"added-material\">plant material<\/span>\u00a0for the purpose of protecting or maintaining an electric powerline, telephone line, or other property of a public utility.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(3)\u2002A person<\/span>\u00a0engaged in logging operations\u00a0<span class=\"added-material\">or fire suppression<\/span>.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(f)\u2002A violation of this section shall be a misdemeanor, punishable by a fine of not more than one thousand dollars ($1,000), by imprisonment in a county jail for not more than six months, or by both that fine and imprisonment.<\/span><\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\"
