class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(a)<\/span>\u2002Data filed\u00a0<span class=\"added-material\">with the board<\/span>\u00a0by any member<span class=\"added-material\">, retired member, beneficiary, or annuitant<\/span>\u00a0is confidential, and\u00a0<span class=\"added-material\">an<\/span>\u00a0individual record shall\u00a0<span class=\"added-material\">not<\/span>\u00a0be divulged by any official or employee having access to it to any person other than the\u00a0<span class=\"added-material\">following:<\/span><\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(1)\u2002The<\/span>\u00a0member<span class=\"added-material\">, retired member, beneficiary, or annuitant<\/span>\u00a0to whom the information relates<span class=\"added-material\">,<\/span>\u00a0or his or her authorized representative<span class=\"added-material\">.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(2)\u2002A contracting agency, school district, or the university, if the member, retired member, beneficiary, or annuitant is or was employed by that entity. \u2002A contracting agency, school district, or the university may also be provided with records that relate to the beneficiary of a member or retired member who is or was employed by the entity.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(3)\u2002Any<\/span>\u00a0state department or agency, or the university.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(b)<\/span>\u2002The information shall be used by the board for the sole purpose of carrying into effect the provisions of this part\u00a0<span class=\"added-material\">and Part 5 (commencing with\u00a0<span class=\"cite\">Section 22750\u00a0<\/span>)<\/span>. \u2002Any information that is requested\u00a0<span class=\"added-material\">to which this section applies shall be treated as confidential and shall be used solely<\/span>\u00a0for retirement purposes<span class=\"added-material\">, including, but not limited to, the administration and funding of retirement and health benefits, and related reporting and notice obligations<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(c)<\/span>\u2002The gross amount of any benefit or any refund of a PERS contribution due to a member<span class=\"added-material\">, retired member,<\/span>\u00a0or beneficiary\u00a0<span class=\"added-material\">under this part<\/span>\u00a0is not confidential and may be released upon request to the board.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(d)<\/span>\u2002The board may seek reimbursement for reasonable administrative expenses incurred when providing\u00a0information. \u2002Except as provided by this section,\u00a0<span class=\"added-material\">a<\/span>\u00a0member&#8217;s,\u00a0<span class=\"added-material\">retired member&#8217;s,<\/span>\u00a0beneficiary&#8217;s<span class=\"added-material\">,<\/span>\u00a0or annuitant&#8217;s address, home telephone number, or other personal information shall\u00a0<span class=\"added-material\">not<\/span>\u00a0be released.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(e)<\/span>\u2002For purposes of this section<span class=\"added-material\">:<\/span><\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(1)\u2002\u201c<\/span>\u00a0<span class=\"wordphrase\">Annuitant<\/span>\u00a0<span class=\"added-material\">\u201d has the meaning provided in\u00a0<span class=\"cite\">Section 22760\u00a0<\/span>.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(2)\u2002\u201c<\/span><span class=\"wordphrase\">Authorized representative<\/span>\u201d includes\u00a0<span class=\"added-material\">a<\/span>\u00a0spouse or\u00a0<span class=\"added-material\">a<\/span>\u00a0beneficiary\u00a0<span class=\"added-material\">if<\/span>\u00a0a\u00a0contrary appointment has\u00a0<span class=\"added-material\">not<\/span>\u00a0been made and when, in the opinion of the board, the member<span class=\"added-material\">, retired member, beneficiary, or annuitant<\/span>\u00a0is prevented from appointing an authorized representative because of mental or physical incapacity or death.<\/p>\n<\/div>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a
