Debtor exemptions: homestead exemption.<\/p>\n<p>Existing law provides that a specified portion of equity in a homestead, as defined, is exempt from execution to satisfy a judgment debt and prescribes that the amount of the homestead exemption is either $75,000, $100,000, or $175,000, depending on certain characteristics of the homestead\u2019s residents.<\/p>\n<p>This bill would instead make the homestead exemption the greater of $300,000 or the countywide median sale price of a single-family home in the\u00a0calendar\u00a0year prior to the\u00a0calendar\u00a0year in which the judgment debtor claims the exemption, not to exceed $600,000. These amounts would adjust annually for inflation.<\/p>\n<p>Vote:\u00a0majority\u00a0\u00a0\u00a0Appropriation:\u00a0no\u00a0\u00a0\u00a0Fiscal Committee:\u00a0no\u00a0\u00a0\u00a0Local Program:\u00a0no<\/p>\n<hr \/>\n<p>THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:<\/p>\n<p><strong>SECTION 1.<\/strong><\/p>\n<p>Section 704.730 of the Code of Civil Procedure is amended to read:<\/p>\n<p><strong>704.730.<\/strong><\/p>\n<p>(a)\u00a0The amount of the homestead exemption is the greater of the following:<\/p>\n<p>(1)\u00a0The countywide median sale price for a single-family home in the\u00a0calendar\u00a0year prior to the\u00a0calendar\u00a0year in which the judgment debtor claims the exemption, not to exceed six hundred thousand dollars ($600,000).<\/p>\n<p>(2)\u00a0Three hundred thousand dollars ($300,000).<\/p>\n<p>(b)\u00a0The amounts specified in this section shall adjust annually for inflation, beginning on January 1, 2022, based on the change in the annual California Consumer Price Index for All Urban Consumers for the prior fiscal year,\u00a0published by the Department of Industrial Relations.<\/p>\n<hr \/>\n<p>SB 832<\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":3,"featured_media":0,"parent":2019,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-376","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.7 -
