av-l35vts31-12bc06cdd35908ef812001b63fda2f19 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><div class=\"row\">\n<div class=\"subsection\">As used in this part:<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(a)\u2002\u201c<span class=\"wordphrase\">Person<\/span>\u201d means any individual, partnership, corporation, limited liability company, or association, and includes, but is not limited to, employers, manufacturers, jobbers, wholesalers, contractors,\u00a0subcontractors<span class=\"added-material\">, and any other person or entity engaged in the business of garment manufacturing<\/span>.<\/p>\n<p>\u201cPerson\u201d does not include any person who manufactures garments by himself or herself, without the assistance of a contractor, employee, or others; \u2009any person who engages solely in that part of the business engaged solely in cleaning, alteration, or tailoring; \u2009any person who engages in the activities herein regulated as an employee with wages as his or her sole compensation; \u2009or any person as provided by regulation.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002\u201c<span class=\"wordphrase\">Garment manufacturing<\/span>\u201d means sewing, cutting, making, processing, repairing, finishing, assembling, or otherwise preparing any garment or any article of wearing apparel or accessories designed or intended to be worn by any individual, including, but not limited to, clothing, hats, gloves, handbags, hosiery, ties, scarfs, and belts, for sale or resale by any person or any persons contracting to have<span class=\"added-material\">those<\/span>\u00a0operations performed\u00a0<span class=\"added-material\">and other operations and practices in the apparel industry as may be identified in regulations of the Department of Industrial Relations consistent with the purposes of this part. \u2002The Department of Industrial Relations shall adopt, and may from time to time amend, regulations to clarify and refine this definition to be consistent with current and future industry practices, but the regulations shall not limit the scope of garment manufacturing, as defined in this subdivision<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002\u201c<span class=\"wordphrase\">Commissioner<\/span>\u201d means the Labor Commissioner.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(d)\u2002\u201c<span class=\"wordphrase\">Contractor<\/span>\u201d means any person who, with the assistance of employees or others, is primarily engaged in sewing, cutting, making, processing, repairing, finishing, assembling, or otherwise preparing any garment or any article of wearing apparel or accessories designed or intended to be worn by any individual, including, but not limited to, clothing, hats, gloves, handbags, hosiery, ties, scarfs, and belts, for another person. \u201c<span class=\"wordphrase\">Contractor<\/span>\u201d includes a subcontractor that is primarily engaged in those operations.<\/span><\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a
