Definitions<\/h2>\n<\/div>\n<div class=\"subsection\">For purposes of this chapter, the following terms have the following meanings:<\/p>\n<div class=\"subsection\">\n<p>(a)\u2002\u201c<span class=\"wordphrase\">California law enforcement agency<\/span>\u201d means a state or local law enforcement agency, including school police or security departments. \u2002\u201cCalifornia law enforcement agency\u201d does not include the Department of Corrections and Rehabilitation.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002\u201c<span class=\"wordphrase\">Civil immigration warrant<\/span>\u201d means any warrant for a violation of federal civil immigration law, and includes civil immigration warrants entered in the National Crime Information Center database.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002\u201c<span class=\"wordphrase\">Immigration authority<\/span>\u201d means any federal, state, or local officer, employee, or person performing immigration enforcement functions.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002\u201c<span class=\"wordphrase\">Health facility<\/span>\u201d includes health facilities as defined in\u00a0<span class=\"cite\">Section 1250 of the Health and Safety Code\u00a0<\/span>, clinics as defined in\u00a0<span class=\"cite\">Sections 1200\u00a0<\/span>and\u00a0<span class=\"cite\">1200.1 of the Health and Safety Code\u00a0<\/span>, and substance abuse treatment facilities.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002\u201cHold request,\u201d \u201cnotification request,\u201d \u201ctransfer request,\u201d and \u201clocal law enforcement agency\u201d have the same meaning as provided in\u00a0<span class=\"cite\">Section 7283\u00a0<\/span>. \u2002Hold, notification, and transfer requests include requests issued by United States Immigration and Customs Enforcement or United States Customs and Border Protection as well as any other immigration authorities.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(f)\u2002\u201c<span class=\"wordphrase\">Immigration enforcement<\/span>\u201d includes any and all efforts to investigate, enforce, or assist in the investigation or enforcement of any federal civil immigration law, and also includes any and all efforts to investigate, enforce, or assist in the investigation or enforcement of any federal criminal immigration law that penalizes a person&#8217;s presence in, entry, or reentry to, or employment in, the United States.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(g)\u2002\u201c<span class=\"wordphrase\">Joint law enforcement task force<\/span>\u201d means at least one California law enforcement agency collaborating, engaging, or partnering with at least one federal law enforcement agency in investigating federal or state crimes.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(h)\u2002\u201c<span class=\"wordphrase\">Judicial probable cause determination<\/span>\u201d means a determination made by a federal judge or federal magistrate judge that probable cause exists that an individual has violated federal criminal immigration law and that authorizes a law enforcement officer to arrest and take into custody the individual.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(i)\u2002\u201c<span class=\"wordphrase\">Judicial warrant<\/span>\u201d means a warrant based on probable cause for a violation of federal criminal immigration law and issued by a federal judge or a federal magistrate judge that authorizes a law enforcement officer to arrest and take into custody the person who is the subject of the warrant.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(j)\u2002\u201c<span class=\"wordphrase\">Public schools<\/span>\u201d means all public elementary and secondary schools under the jurisdiction of local governing boards or a charter school board, the California State University, and the California Community Colleges.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(k)\u2002\u201c<span class=\"wordphrase\">School police and security departments<\/span>\u201d includes police and security departments of the California State University, the California Community Colleges, charter schools, county offices of education, schools, and school districts.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":9,"featured_media":0,"parent":2019,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-3939","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
