av-l365gvrn-1c677b4b2cdb0500c34e3928b38ab695 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><div class=\"row\">\n<div class=\"subsection\">(a)\u2002Claims against a local public entity for money or damages which are excepted by <span class=\"cite\">Section 905\u00a0<\/span>from Chapter 1 (commencing with\u00a0<span class=\"cite\">Section 900\u00a0<\/span>) and Chapter 2 (commencing with\u00a0<span class=\"cite\">Section 910\u00a0<\/span>) of this part, and which are not governed by any other statutes or regulations expressly relating thereto, shall be governed by the procedure prescribed in any charter, ordinance<span class=\"added-material\">,<\/span>\u00a0or regulation adopted by the local public entity.<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(b)\u2002The procedure so prescribed may include a requirement that a claim be presented and acted upon as a prerequisite to suit thereon. \u2002If such\u00a0<span class=\"added-material\">a<\/span>\u00a0requirement is included, any action brought against the public entity on the claim shall be subject to\u00a0<span class=\"cite\">Sections 945.6\u00a0<\/span>and\u00a0946.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002The procedure so prescribed\u00a0<span class=\"added-material\">shall<\/span>\u00a0not require a shorter time for presentation of any claim than the time provided in\u00a0<span class=\"cite\">Section 911.2\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002The procedure so prescribed\u00a0<span class=\"added-material\">shall<\/span>\u00a0not provide a longer time for the board to take action upon any claim than the time provided in\u00a0<span class=\"cite\">Section 912.4\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002When a claim required by the procedure to be presented within a period of less than one year after the accrual of the cause of action is not presented within the required time, an application may be made to the public entity for leave to present such claim. \u2002<span class=\"cite\">\u00a0Subdivision (b) of Section 911.4\u00a0<\/span>,\u00a0<span class=\"cite\">Sections 911.6\u00a0<\/span>to\u00a0<span class=\"cite\">912.2\u00a0<\/span>, inclusive, and\u00a0<span class=\"cite\">Sections 946.4\u00a0<\/span>and\u00a0<span class=\"cite\">946.6\u00a0<\/span>are applicable to all such claims, and the time specified in the charter, ordinance<span class=\"added-material\">,<\/span>\u00a0or regulation shall be deemed the \u201ctime specified in\u00a0<span class=\"cite\">Section 911.2\u00a0<\/span>\u201d within the meaning of\u00a0<span class=\"cite\">Sections 911.6\u00a0<\/span>and\u00a0<span class=\"cite\">946.6\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(f)\u2002Any procedure authorized to be prescribed by this section does not apply to claims of childhood sexual abuse made as described in\u00a0<span class=\"cite\">subdivision (m) of Section 905\u00a0<\/span>. \u2002This subdivision is declaratory of existing law.<\/span><\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a
