itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><div class=\"row\">\n<div class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div>\n<h2 class=\"SS_Banner\">BPC \u00a7\u2002<span class=\"SS_SH SS_prior SS_tu1\">6450<\/span>. \u201cParalegal\u201d; Requirements<\/h2>\n<\/div>\n<div class=\"subsection\">(a)\u2002\u201c<span class=\"wordphrase\">Paralegal<\/span>\u201d means a person who holds himself or herself out to be a paralegal, who is qualified by education, training, or work experience, who either contracts with or is employed by an attorney, law firm, corporation, governmental agency, or other entity, and who performs substantial legal work under the direction and supervision of an active member of the State Bar of California, as defined in\u00a0<span class=\"cite\">Section 6060\u00a0<\/span>, or an attorney practicing law in the federal courts of this state, that has been specifically delegated by the attorney to him or her. \u2002Tasks performed by a paralegal include, but are not limited to, case planning, development, and management; \u2009legal research; \u2009interviewing clients; \u2009fact gathering and retrieving information; \u2009drafting and analyzing legal documents; \u2009collecting, compiling, and utilizing technical information to make an independent decision and recommendation to the supervising attorney; \u2009and representing clients before a state or federal administrative agency if that representation is permitted by statute, court rule, or administrative rule or regulation.<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002Notwithstanding subdivision (a), a paralegal shall not do the following:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px;\">(1)\u2002Provide legal advice.<\/p>\n<\/div>\n<div class=\"subsection\" style=\"padding-left: 40px;\">\n<p>(2)\u2002Represent a client in court.<\/p>\n<\/div>\n<div class=\"subsection\" style=\"padding-left: 40px;\">\n<p>(3)\u2002Select, explain, draft, or recommend the use of any legal document to or for any person other than the attorney who directs and supervises the paralegal.<\/p>\n<\/div>\n<div class=\"subsection\" style=\"padding-left: 40px;\">\n<p>(4)\u2002Act as a runner or capper, as defined in\u00a0<span class=\"cite\">Sections 6151\u00a0<\/span>and\u00a0<span class=\"cite\">6152\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\" style=\"padding-left: 40px;\">\n<p>(5)\u2002Engage in conduct that constitutes the unlawful practice of law.<\/p>\n<\/div>\n<div class=\"subsection\" style=\"padding-left: 40px;\">\n<p>(6)\u2002Contract with, or be employed by, a natural person other than an attorney to perform paralegal services.<\/p>\n<\/div>\n<div class=\"subsection\" style=\"padding-left: 40px;\">\n<p>(7)\u2002In connection with providing paralegal services, induce a person to make an investment, purchase a financial product or service, or enter a transaction from which income or profit, or both, purportedly may be derived.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px;\">(8)\u2002Establish the fees to charge a client for the services the paralegal performs, which shall be established by the attorney who supervises the paralegal&#8217;s work. \u2002This paragraph does not apply to fees charged by a paralegal in a contract to provide paralegal services to an attorney, law firm, corporation, governmental agency, or other entity as provided in subdivision (a).<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002A paralegal shall possess at least one of the following:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px;\">(1)\u2002A certificate of completion of a paralegal program approved by the American Bar Association.<\/p>\n<\/div>\n<div class=\"subsection\" style=\"padding-left: 40px;\">\n<p>(2)\u2002A certificate of completion of a paralegal program at, or a degree from, a postsecondary institution that requires the successful completion of a minimum of 24 semester, or equivalent, units in law-related courses and that has been accredited by a national or regional accrediting organization or approved by the Bureau for Private Postsecondary and Vocational Education.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px;\">(3)\u2002A baccalaureate degree or an advanced degree in any subject, a minimum of one year of law-related experience under the supervision of an attorney who has been an active member of the State Bar of California for at least the preceding three years or who has practiced in the federal courts of this state for at least the preceding three years, and a written declaration from this attorney stating that the person is qualified to perform paralegal tasks.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px;\">(4)\u2002A high school diploma or general equivalency diploma, a minimum of three years of law-related experience under the supervision of an attorney who has been an active member of the State Bar of California for at least the preceding three years or who has practiced in the federal courts of this state for at least the preceding three years, and a written declaration from this attorney stating that the person is qualified to perform paralegal tasks. \u2002This experience and training shall be completed no later than December 31, 2003.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002<span class=\"added-material\">Every two years, commencing January 1, 2007, any person that is working as a paralegal<\/span>\u00a0shall be required to certify completion\u00a0of four hours of mandatory continuing legal education in legal ethics\u00a0<span class=\"added-material\">and four hours of mandatory continuing legal education in either general law or in an area of specialized law<\/span>. \u2002All continuing legal education courses shall meet the requirements of\u00a0<span class=\"cite\">Section 6070\u00a0<\/span>. \u2002Certification of these continuing education requirements shall be made with the paralegal&#8217;s supervising attorney. \u2002The paralegal shall be responsible for keeping a record of the paralegal&#8217;s certifications.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002A paralegal does not include a nonlawyer who provides legal services directly to members of the public, or a legal document assistant or unlawful detainer assistant as defined in\u00a0<span class=\"cite\">Section 6400\u00a0<\/span>, unless the person is a person described in subdivision (a).<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(f)\u2002This section shall become operative on January 1, 2004.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\"
