av-l371vppb-2aa597631d0e55756bdf71794883b65a '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><div class=\"row\">\n<div class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<p>As used in this chapter:<\/p>\n<div class=\"subsection\">\n<p>(a)\u2002\u201cActuarial Standards Board\u201d means the board established by the American Academy of Actuaries to develop and promulgate standards of actuarial practice.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002\u201c<span class=\"wordphrase\">Contract premium<\/span>\u201d means the gross premium that is required to be paid under a fixed premium policy, including the premium for a rider for which benefits are shown in the illustration.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002\u201c<span class=\"wordphrase\">Currently payable scale<\/span>\u201d means a scale of nonguaranteed elements in effect for a policy form as of the preparation date of the illustration or declared to become effective within the next 95 days.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002\u201c<span class=\"wordphrase\">Disciplined current scale<\/span>\u201d means a scale of nonguaranteed elements constituting a limit on illustrations currently being illustrated by an insurer that is reasonably based on actual recent historical experience, as certified annually by an illustration actuary designated by the insurer. \u2002Further guidance in determining the disciplined current scale as contained in standards established by the Actuarial Standards Board may be relied upon if the standards meet all of the following:<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002Have not been found to be inconsistent with the provisions of this chapter by the commissioner after a hearing held in accordance with\u00a0<span class=\"cite\">Sections 11500\u00a0<\/span>to\u00a0<span class=\"cite\">11530, inclusive, of the Government Code\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002Limit a disciplined current scale to reflect only actions that have already been taken or events that have already occurred.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(3)\u2002Do not permit a disciplined current scale to include any projected trends of improvements in experience or any assumed improvements in experience beyond the illustration date.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(4)\u2002Do not permit assumed expenses to be less than minimum assumed expenses.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002\u201c<span class=\"wordphrase\">Generic name<\/span>\u201d means a short title descriptive of the policy being illustrated such as whole life, \u201cterm life\u201d or \u201cflexible premium adjustable life.\u201d<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(f)\u2002\u201c<span class=\"wordphrase\">Guaranteed elements<\/span>\u201d means the premiums, benefits, values, credits or charges under a policy of life insurance that are guaranteed and determined at issue.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(g)\u2002\u201c<span class=\"wordphrase\">Illustrated scale<\/span>\u201d means a scale of nonguaranteed elements currently being illustrated that is not more favorable to the policy owner than the lesser of either of the following:<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002The disciplined current scale.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002The currently payable scale.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(h)\u2002\u201c<span class=\"wordphrase\">Illustration<\/span>\u201d means a presentation or depiction that includes nonguaranteed elements of a policy of life insurance over a period of years and that is one of the three types defined below:<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002\u201c<span class=\"wordphrase\">Basic illustration<\/span>\u201d means a ledger or proposal used in the sale of a life insurance policy that shows both guaranteed and nonguaranteed elements.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002\u201c<span class=\"wordphrase\">Supplemental illustration<\/span>\u201d means an illustration furnished in addition to a basic illustration that meets the applicable requirements of this regulation, and that may be presented in a format differing from the basic illustration, but may only depict a scale of nonguaranteed elements that is permitted in a basic illustration.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(3)\u2002\u201c<span class=\"wordphrase\">In force illustration<\/span>\u201d means an illustration furnished at any time after the policy that it depicts has been in force for one year or more.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(i)\u2002\u201c<span class=\"wordphrase\">Illustration actuary<\/span>\u201d means an actuary meeting the requirements of\u00a0<span class=\"cite\">Section 10509.960\u00a0<\/span>who certifies to illustrations based on the standard of practice promulgated by the Actuarial Standards Board.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(j)\u2002\u201cLapse-supported illustration\u201d means an illustration of a policy form failing the test of self-supporting as defined in this chapter, under a modified persistency rate assumption using persistency rates underlying the disciplined current scale for the first five years and 100 percent policy persistency thereafter.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(k)\u2002\u201c<span class=\"wordphrase\">Life insurance<\/span>\u201d means insurance upon the lives of persons or appertaining thereto.<\/p>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(<i>l<\/i>)(1)\u2002\u201c<span class=\"wordphrase\">Minimum assumed expenses<\/span>\u201d means the minimum expenses that may be used in the calculation of the disciplined current scale for a policy form. \u2002The insurer may choose to designate each year the method of determining assumed expenses for all policy forms from all of the following:<\/p>\n<div class=\"subsection\">\n<p>(A)\u2002Fully allocated expenses.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(B)\u2002Marginal expenses.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(C)\u2002A generally recognized expense table based on fully allocated expenses representing a significant portion of insurance companies and approved by the commissioner.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002Marginal expenses may be used only if greater than a generally recognized expense table. \u2002If no generally recognized expense table is approved, fully allocated expenses must be used.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(m)\u2002\u201cNon-guaranteed elements\u201d means the premiums, benefits, values, credits or charges under a policy of life insurance that are not guaranteed or not determined at issue.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(n)\u2002\u201cNon-term group life\u201d means a group policy or individual policies of life insurance issued to members of an employer group or other permitted group that includes all of the following:<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002Every plan of coverage was selected by the employer or other group representative.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002Some portion of the premium is paid by the group or through payroll deduction.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(3)\u2002Group underwriting or simplified underwriting is used.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(<i>o<\/i>)\u2002\u201c<span class=\"wordphrase\">Policy owner<\/span>\u201d means the owner named in the policy or the certificate holder in the case of a group policy.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(p)\u2002\u201c<span class=\"wordphrase\">Premium outlay<\/span>\u201d means the amount of premium assumed to be paid by the policy owner or other premium payer out-of-pocket.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(q)\u2002\u201cSelf-supporting illustration\u201d means an illustration of a policy form for which it can be demonstrated that, when using experience assumptions underlying the disciplined current scale, for all illustrated points in time on or after the 15th policy anniversary or the 20th policy anniversary for second-or-later-to-die policies (or upon policy expiration if sooner), the accumulated value of all policy cash-flows equals or exceeds the total policy owner value available. \u2002For this purpose, policy owner value will include cash surrender values and any other illustrated benefit amounts available at the policy owner&#8217;s election.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":7,"featured_media":0,"parent":2019,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-4321","page","type-page","status-publish","hentry"],"yoast_head":"<!--
