class=\"subsection\"><span class=\"added-material\">(a)<\/span>\u2002A court-ordered\u00a0<span class=\"added-material\">family centered<\/span>\u00a0case\u00a0<span class=\"added-material\">resolution<\/span>\u00a0plan\u00a0<span class=\"added-material\">must be in conformance with due process requirements and<\/span>\u00a0may include<span class=\"added-material\">, but is not limited to,<\/span>\u00a0all of the following:<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(1)<\/span>\u2002Early neutral case evaluation.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(2)<\/span>\u2002Alternative dispute resolution\u00a0<span class=\"added-material\">consistent with the requirements of\u00a0<span class=\"cite\">subdivision (a) of Section 3181\u00a0<\/span><\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(3)<\/span>\u2002Limitations on discovery, including temporary suspension pending exploration of settlement. \u2002There is a rebuttable presumption that an attorney who carries out discovery as provided in a\u00a0<span class=\"added-material\">family centered<\/span>\u00a0case\u00a0<span class=\"added-material\">resolution<\/span>\u00a0plan has fulfilled his or her duty of care to the client as to the existence of community property.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(4)<\/span>\u2002Use of telephone conference calls to ascertain the status of the case, encourage cooperation, and assist counsel in reaching agreement. \u2002However, if the court is required to issue an order other than by stipulation, a hearing shall be held.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(5)\u2002If stipulated by the parties, modification or waiver of the requirements of procedural statutes.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(6)<\/span>\u2002A requirement that any expert witness be selected by the parties jointly or be appointed by the court. \u2002However, if at any time the court determines that the issues for which experts are required cannot be settled under these conditions, the court shall permit each party to employ his or her own expert.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(7)<\/span>\u2002Bifurcation of issues for trial.<\/p>\n<p>(b)\u2002This section does not provide any additional authority to the court to appoint experts beyond that permitted under other provisions of law.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(c)\u2002The Judicial Council shall, by January 1, 2012, adopt a statewide rule of court to implement this section.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(d)\u2002The changes made to this section by the act adding this subdivision\u00a0<span class=\"footnote-reference\">\u20091<\/span>\u00a0shall become operative on January 1, 2012.<\/span><\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\"
