State agencies: nonprofit liaison.<\/p>\n<p>Existing law requires a state agency that significantly regulates or impacts small business to designate a person to serve as a small business liaison for the state agency, and specifies the duties of a small business liaison, including receiving and responding to complaints about the agency from small businesses and providing technical advice and assisting small businesses in resolving problems and questions regarding compliance with the agency\u2019s regulations and relevant statutes.<\/p>\n<p>This bill would require a state\u00a0agency, except as provided,\u00a0that significantly regulates or impacts nonprofit corporations to designate a person to serve as a non-profit liason if the use of existing personnel and resources allows for performance of the duties of the nonprofit liaison.\u00a0The bill would require the state agency to advertise the existence of the nonprofit on the state agency\u2019s internet website.\u00a0The bill would establish the responsibilities of a nonprofit liaison, including responding to complaints by nonprofit corporations about the agency and assisting nonprofit corporations with complying with the state agency\u2019s regulations and relevant statutes. The bill would prohibit the nonprofit liaison from advocating for or against the adoption, amendment, or repeal of a regulation, or intervening in a pending investigation or enforcement action.<\/p>\n<p>Vote:\u00a0majority\u00a0\u00a0\u00a0Appropriation:\u00a0no\u00a0\u00a0\u00a0Fiscal Committee:\u00a0yes\u00a0\u00a0\u00a0Local Program:\u00a0no<\/p>\n<hr \/>\n<p>THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:<\/p>\n<p><strong>SECTION 1.<\/strong><\/p>\n<p>Article 15 (commencing with Section 11149) is added to Chapter 1 of Part 1 of Division 3 of Title 2 of the Government Code, to read:<\/p>\n<p><strong>Article \u00a015.\u00a0Nonprofit Liaison<\/strong><\/p>\n<p><strong>11149.<\/strong><\/p>\n<p>(a)\u00a0For purposes of this article:<\/p>\n<p>(1)\u00a0\u201cNonprofit corporation\u201d means a corporation organized under Part 2 (commencing with Section 5110) or Part 3 (commencing with Section 7110) of Division 2 of Title 1 of the Corporations Code.<\/p>\n<p>(2)\u00a0(A)\u00a0\u201cState agency\u201d means a state agency that significantly regulates or significantly impacts nonprofit corporations.<\/p>\n<p>(B)\u00a0\u201cState agency\u201d does not include the Department of Justice.<\/p>\n<p>(b)\u00a0A state agency shall designate at least one person to serve as a non-profit liaison if the\u00a0use\u00a0of\u00a0existing personnel and resources allows for performance of\u00a0the duties of the nonprofit liaison.<\/p>\n<p>(c)\u00a0A state agency shall advertise the existence of its designated nonprofit liaison by displaying the nonprofit liaison\u2019s name and contact information on the state agency\u2019s internet website.<\/p>\n<p>(d)\u00a0A nonprofit liaison shall be responsible for all of the following:<\/p>\n<p>(1)\u00a0Responding to complaints from nonprofit corporations about the state agency.<\/p>\n<p>(2)\u00a0Providing technical assistance to nonprofit corporations to help them comply with the state agency\u2019s regulations.<\/p>\n<p>(3)\u00a0Reporting nonprofit corporation concerns and recommendations to the agency head, as defined in Section 11405.40.<\/p>\n<p>(4)\u00a0Developing and sharing innovative procurement and contracting practices to increase opportunities for nonprofit corporations.<\/p>\n<p>(e)\u00a0The nonprofit liaison shall not advocate for or against the adoption, amendment, or repeal of a regulation, or intervene in a pending investigation or enforcement action.<\/p>\n<hr \/>\n<p>SB 543<\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":3,"featured_media":0,"parent":2019,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-452","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.1 -
