av-l37dujbz-d62974d435da5456ba2aaa59ddb41e5d '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><div class=\"row\">\n<div class=\"subsection\">(a)\u2002The department shall issue allocations to <span class=\"added-material\">contracting<\/span>\u00a0counties for alcohol and other drug programs.<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(b)\u2002In issuing allocations to\u00a0<span class=\"added-material\">contracting<\/span>\u00a0counties, it is the intent of the Legislature that counties shall allocate all funds received pursuant to state and federal laws and regulations.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002The department shall estimate an allocation of\u00a0federal funds available for each county to\u00a0<span class=\"added-material\">use as the basis for submission of the<\/span>\u00a0contract. \u2002In making allocations, the department shall base its allocations on the population of each county. \u2002However, the department shall\u00a0<span class=\"added-material\">ensure<\/span>\u00a0that each small population county receives a minimum amount of funds to provide adequate alcohol and other drug services. \u2002The department may take into account other factors in making the allocations<span class=\"added-material\">, including, but not limited to,<\/span>\u00a0factors\u00a0<span class=\"added-material\">that<\/span>\u00a0relate to the level of alcohol and other drug problems in the county. \u2002No later than 45 days after introduction of the Budget Bill, the department shall notify each county regarding its preliminary allocation under this division\u00a0<span class=\"added-material\">and estimated amount of the federally required maintenance of effort statewide expenditure levels on authorized activities, as defined in the federal Substance Abuse Prevention and Treatment Block Grant funds (<span class=\"cite\">\u00a042 U.S.C. Sec. 300x-30\u00a0<\/span>)<\/span>, pending enactment of the Budget Bill. \u2002The 1984-85 fiscal year shall establish the base funding for the county alcohol and drug allocation for local programs. \u2002Beginning with the 1985-86 fiscal year, cost-of-living adjustments, if granted, shall be considered as tied to the base allocation established in the 1984-85 fiscal year, plus any subsequent cost-of-living adjustments. \u2002The department shall notify each county regarding its final allocation after enactment of the Budget Bill.<\/p>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(d)<span class=\"added-material\">(1)<\/span>\u2002Notwithstanding any other provision in this section, the director may reduce\u00a0<span class=\"added-material\">federal<\/span>\u00a0funding\u00a0<span class=\"added-material\">allocations, on a dollar-for-dollar basis, to a county that has reduced or anticipates reducing expenditures in a way that would result in a decrease in the federal Substance Abuse Prevention and Treatment Block Grant funds (<span class=\"cite\">\u00a042 U.S.C. Sec. 300x-30\u00a0<\/span>)<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(2)\u2002Prior to making any reductions pursuant to this subdivision, the director shall notify all counties that county underspending will reduce the federal Substance Abuse Prevention and Treatment Block Grant maintenance of effort (MOE). \u2002Upon receipt of notification, a county may submit a revision to the county budget initially submitted pursuant to\u00a0<span class=\"cite\">subdivision (a) of Section 11798\u00a0<\/span>in an effort to maintain the statewide Substance Abuse Prevention and Treatment Block Grant MOE.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(3)\u2002Pursuant to\u00a0<span class=\"cite\">subdivision (b) of Section 11798.1\u00a0<\/span>, a county shall notify the department in writing of proposed local changes to the county&#8217;s expenditure of funds. \u2002The department shall review and may approve the proposed local changes depending on the level of expenditures needed to maintain the statewide Substance Abuse Prevention and Treatment Block Grant MOE.<\/span><\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(e)(1)\u2002Notwithstanding the rulemaking provisions of Chapter 3.5 (commencing with\u00a0<span class=\"cite\">Section 11340) of Part 1 of Division 3 of Title 2 of the Government Code\u00a0<\/span>, the department may implement, interpret, or make specific the amendments to this section made by the act\u2009\u00a0<span class=\"footnote-reference\">\u20091<\/span>\u00a0that added this subdivision by means of all-county letters, plan letters, plan or provider bulletins, or similar instructions from the department until regulations are adopted pursuant to that chapter of the Government Code.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(2)\u2002The department shall adopt emergency regulations no later than July 1, 2014. \u2002The department may subsequently readopt any emergency regulation authorized by this section that is the same as or is substantially equivalent to an emergency regulation previously adopted pursuant to this section.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\"><span class=\"added-material\">(3)\u2002The initial adoption of emergency regulations implementing the amendments to this section and the one readoption of emergency regulations authorized by this subdivision shall be deemed an emergency and necessary for the immediate preservation of the public peace, health, safety, or general welfare. \u2002Initial emergency regulations and the one readoption of emergency regulations authorized by this section shall be exempt from review by the Office of Administrative Law. \u2002The initial emergency regulations and the one readoption of emergency regulations authorized by this section shall be submitted to the Office of Administrative Law for filing with the Secretary of State and each shall remain in effect for no more than 180 days, by which time final regulations may be adopted.<\/span><\/p>\n<\/div>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":9,"featured_media":0,"parent":2019,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-4702","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.3 -
