class=\"subsection\">(a)\u2002A lead agency may charge and collect a reasonable fee from <span class=\"added-material\">a<\/span>\u00a0person proposing a project subject to this division in order to recover the estimated costs incurred by the lead agency in preparing a negative declaration or an environmental impact report for the project and for procedures necessary to comply with this division on the project. \u2002Litigation expenses, costs, and fees incurred in actions alleging noncompliance with this division under\u00a0<span class=\"cite\">Section 21167\u00a0<\/span>are not recoverable under this section.<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(b)\u2002The Department of Fish and Game may charge and collect filing fees, as provided in\u00a0<span class=\"cite\">Section 711.4 of the Fish and Game Code\u00a0<\/span>. \u2002Notwithstanding\u00a0<span class=\"cite\">Section 21080.1\u00a0<\/span>, a finding required under\u00a0<span class=\"cite\">Section 21081\u00a0<\/span>, or\u00a0<span class=\"added-material\">a<\/span>\u00a0project approved under a certified regulatory program authorized pursuant to\u00a0<span class=\"cite\">Section 21080.5\u00a0<\/span>is not operative, vested, or final until the filing fees required pursuant to\u00a0<span class=\"cite\">Section 711.4 of the Fish and Game Code\u00a0<\/span>are paid.<\/p>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(c)(1)\u2002A public agency may charge and collect a reasonable fee from members of the public for a copy of an environmental document not to exceed the cost of reproducing the environmental document. \u2002A public agency may provide the environmental document in an electronic format as provided pursuant to\u00a0<span class=\"cite\">Section 6253.9 of the Government Code\u00a0<\/span>.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002<span class=\"added-material\">For purposes of this subdivision, \u201c<span class=\"wordphrase\">environmental document<\/span>\u201d means an initial study, negative declaration, mitigated negative declaration, draft and final environmental impact report, a document prepared as a substitute for an environmental impact report, negative declaration, or mitigated negative declaration under a program certified pursuant to\u00a0<span class=\"cite\">Section 21080.5\u00a0<\/span>, and a document prepared under the federal National Environmental Policy Act of 1969 (<span class=\"cite\">\u00a042 U.S.C.
