class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(a)\u2002<span class=\"added-material\">A<\/span>\u00a0health practitioner<span class=\"added-material\">, as defined in\u00a0<span class=\"cite\">subdivision (a) of Section 11162.5\u00a0<\/span>,<\/span>\u00a0employed\u00a0<span class=\"added-material\">by<\/span>\u00a0a health facility, clinic, physician&#8217;s office, local or state public health department,\u00a0<span class=\"added-material\">local government agency,<\/span>\u00a0or a clinic or other type of facility operated by a local or state public health department who, in his or her professional capacity or within the scope of his or her employment, provides medical services for a physical condition to a patient whom he or she knows or reasonably suspects is a person described as follows, shall immediately make a report in accordance with subdivision (b):<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002<span class=\"added-material\">A<\/span>\u00a0person suffering from any wound or other physical injury inflicted by his or her own act or inflicted by another where the injury is by means of a firearm.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002<span class=\"added-material\">A<\/span>\u00a0person suffering from any wound or other physical injury inflicted upon the person where the injury is the result of assaultive or abusive conduct.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002<span class=\"added-material\">A<\/span>\u00a0health practitioner<span class=\"added-material\">, as defined in\u00a0<span class=\"cite\">subdivision (a) of Section 11162.5\u00a0<\/span>,<\/span>\u00a0employed\u00a0<span class=\"added-material\">by<\/span>\u00a0a health facility, clinic, physician&#8217;s office, local or state public health department,\u00a0<span class=\"added-material\">local government agency,<\/span>\u00a0or a clinic or other type of facility operated by a local or state public health department shall make a report regarding persons described in subdivision (a) to a local law enforcement agency as follows:<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002A report by telephone shall be made immediately or as soon as practically possible.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002A written report shall be prepared on the standard form developed in compliance with paragraph (4) of this subdivision, and\u00a0adopted by the Office of Emergency Services, or on a form developed and adopted by another state agency that otherwise fulfills the requirements of the standard form. \u2002The completed form shall be sent to a local law enforcement agency within two working days of receiving the information regarding the person.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(3)\u2002A local law enforcement agency shall be notified and a written report shall be prepared and sent pursuant to paragraphs (1) and (2) even if the person who suffered the wound, other injury, or assaultive or abusive conduct has expired, regardless of whether or not the wound, other injury, or assaultive or abusive conduct was a factor contributing to the death, and even if the evidence of the conduct of the perpetrator of the wound, other injury, or assaultive or abusive conduct was discovered during an autopsy.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(4)\u2002The report shall include, but shall not be limited to, the following:<\/p>\n<div class=\"subsection\">\n<p>(A)\u2002The name of the injured person, if known.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(B)\u2002The injured person&#8217;s whereabouts.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(C)\u2002The character and extent of the person&#8217;s injuries.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(D)\u2002The identity of any person the injured person alleges inflicted the wound, other injury, or assaultive or abusive conduct upon the injured person.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002For the purposes of this section, \u201c<span class=\"wordphrase\">injury<\/span>\u201d shall not include any psychological or physical condition brought about solely through the voluntary administration of a narcotic or restricted dangerous drug.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002For the purposes of this section, \u201c<span class=\"wordphrase\">assaultive or abusive conduct<\/span>\u201d shall include any of the following offenses:<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002Murder, in violation of\u00a0<span class=\"cite\">Section 187\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002Manslaughter, in violation of\u00a0<span class=\"cite\">Section 192\u00a0<\/span>or\u00a0<span class=\"cite\">192.5\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(3)\u2002Mayhem, in violation of\u00a0<span class=\"cite\">Section 203\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(4)\u2002Aggravated mayhem, in violation of\u00a0<span class=\"cite\">Section 205\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(5)\u2002Torture, in violation of\u00a0<span class=\"cite\">Section 206\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(6)\u2002Assault with intent to commit mayhem, rape, sodomy, or oral copulation, in violation of\u00a0<span class=\"cite\">Section 220\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(7)\u2002Administering controlled substances or anesthetic to aid in commission of a felony, in violation of\u00a0<span class=\"cite\">Section 222\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(8)\u2002Battery, in violation of\u00a0<span class=\"cite\">Section 242\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(9)\u2002Sexual battery, in violation of\u00a0<span class=\"cite\">Section 243.4\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(10)\u2002Incest, in violation of\u00a0<span class=\"cite\">Section 285\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(11)\u2002Throwing any vitriol, corrosive acid, or caustic chemical with intent to injure or disfigure, in violation of\u00a0<span class=\"cite\">Section 244\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(12)\u2002Assault with a stun gun or taser, in violation of\u00a0<span class=\"cite\">Section 244.5\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(13)\u2002Assault with a deadly weapon, firearm, assault weapon, or machinegun, or by means likely to produce great bodily injury, in violation of\u00a0<span class=\"cite\">Section 245\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(14)\u2002Rape, in violation of\u00a0<span class=\"cite\">Section 261\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(15)\u2002Spousal rape, in violation of\u00a0<span class=\"cite\">Section 262\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(16)\u2002Procuring any female to have sex with another man, in violation of\u00a0<span class=\"cite\">Section 266\u00a0<\/span>,\u00a0<span class=\"cite\">266a\u00a0<\/span>,\u00a0<span class=\"cite\">266b\u00a0<\/span>, or\u00a0<span class=\"cite\">266c\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(17)\u2002Child abuse or endangerment, in violation of\u00a0<span class=\"cite\">Section 273a\u00a0<\/span>or\u00a0<span class=\"cite\">273d\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(18)\u2002Abuse of spouse or cohabitant, in violation of\u00a0<span class=\"cite\">Section 273.5\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(19)\u2002Sodomy, in violation of\u00a0<span class=\"cite\">Section 286\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(20)\u2002Lewd and lascivious acts with a child, in violation of\u00a0<span class=\"cite\">Section 288\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(21)\u2002Oral copulation, in violation of\u00a0<span class=\"cite\">Section 288a\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(22)\u2002Sexual penetration, in violation of\u00a0<span class=\"cite\">Section 289\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(23)\u2002Elder abuse, in violation of\u00a0<span class=\"cite\">Section 368\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(24)\u2002An attempt to commit any crime specified in paragraphs (1) to (23), inclusive.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002When two or more persons who are required to report are present and jointly have knowledge of a known or suspected instance of violence that is required to be reported pursuant to this section, and when there is an agreement among these persons to report as a team, the team may select by mutual agreement a member of the team to make a report by telephone and a single written report, as required by subdivision (b). \u2002The written report shall be signed by the selected member of the reporting team. \u2002Any member who has knowledge that the member designated to report has failed to do so shall thereafter make the report.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(f)\u2002The reporting duties under this section are individual, except as provided in subdivision (e).<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(g)\u2002<span class=\"added-material\">A<\/span>\u00a0supervisor or administrator shall\u00a0<span class=\"added-material\">not<\/span>\u00a0impede or inhibit the reporting duties required under this section and\u00a0<span class=\"added-material\">a<\/span>\u00a0person making a report pursuant to this section shall\u00a0<span class=\"added-material\">not<\/span>\u00a0be subject to any sanction for making the report. \u2002However, internal procedures to facilitate reporting and apprise supervisors and administrators of reports may be established, except that these procedures shall not be inconsistent with this article. \u2002The internal procedures shall not require any employee required to make a report under this article to disclose his or her identity to the employer.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(h)\u2002For the purposes of this section, it is the Legislature&#8217;s intent to avoid duplication of information.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(i)\u2002For purposes of this section only, \u201c<span class=\"wordphrase\">employed by a local government agency<\/span>\u201d includes an employee of an entity under contract with a local government agency to provide medical services.<\/span><\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a
