av-l3heg9l6-108f922f02d7dbafa23ba8782af99947 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><div class=\"row\">\n<div class=\"subsection\">(a)\u2002An individual or small group health care service plan contract issued, amended, or renewed on or after January 1, 2017, shall, at a minimum, include coverage for essential health benefits pursuant to PPACA and as outlined in this section. \u2002For purposes of this section, \u201c<span class=\"wordphrase\">essential health benefits<\/span>\u201d means all of the following:<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002Health benefits within the categories identified in Section 1302(b) of PPACA:\u00a0<span class=\"footnote-reference\">\u20091<\/span>\u00a0\u2009ambulatory patient services, emergency services, hospitalization, maternity and newborn care, mental health and substance use disorder services, including behavioral health treatment, prescription drugs, rehabilitative and habilitative services and devices, laboratory services, preventive and wellness services and chronic disease management, and pediatric services, including oral and vision care.<\/p>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)(A)\u2002The health benefits covered by the Kaiser Foundation Health Plan Small Group HMO 30 plan (federal health product identification number 40513CA035) as this plan was offered during the first quarter of 2014, as follows, regardless of whether the benefits are specifically referenced in the evidence of coverage or plan contract for that plan:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(i)\u2002Medically necessary basic health care services, as defined in\u00a0<span class=\"cite\">subdivision (b) of Section 1345\u00a0<\/span>and in\u00a0<span class=\"cite\">Section 1300.67 of Title 28 of the California Code of Regulations\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(ii)\u2002The health benefits mandated to be covered by the plan pursuant to statutes enacted before December 31, 2011, as described in the following sections: \u2009<span class=\"cite\">\u00a0Sections 1367.002\u00a0<\/span>,\u00a0<span class=\"cite\">1367.06\u00a0<\/span>, and\u00a0<span class=\"cite\">1367.35\u00a0<\/span>(preventive services for children);\u00a0<span class=\"cite\">Section 1367.25\u00a0<\/span>(prescription drug coverage for contraceptives);\u00a0<span class=\"cite\">Section 1367.45\u00a0<\/span>(AIDS vaccine);\u00a0<span class=\"cite\">Section 1367.46\u00a0<\/span>(HIV testing);\u00a0<span class=\"cite\">Section 1367.51\u00a0<\/span>(diabetes);\u00a0<span class=\"cite\">Section 1367.54\u00a0<\/span>(<span class=\"added-material\">alpha-fetoprotein<\/span>\u00a0testing);\u00a0<span class=\"cite\">Section 1367.6\u00a0<\/span>(breast cancer screening);\u00a0<span class=\"cite\">Section 1367.61\u00a0<\/span>(prosthetics for laryngectomy);\u00a0<span class=\"cite\">Section 1367.62\u00a0<\/span>(maternity hospital stay);\u00a0<span class=\"cite\">Section 1367.63\u00a0<\/span>(reconstructive surgery);\u00a0<span class=\"cite\">Section 1367.635\u00a0<\/span>(mastectomies);\u00a0<span class=\"cite\">Section 1367.64\u00a0<\/span>(prostate cancer);\u00a0<span class=\"cite\">Section 1367.65\u00a0<\/span>(mammography);\u00a0<span class=\"cite\">Section 1367.66\u00a0<\/span>(cervical cancer);\u00a0<span class=\"cite\">Section 1367.665\u00a0<\/span>(cancer screening tests);\u00a0<span class=\"cite\">Section 1367.67\u00a0<\/span>(osteoporosis);\u00a0<span class=\"cite\">Section 1367.68\u00a0<\/span>(surgical procedures for jaw bones);\u00a0<span class=\"cite\">Section 1367.71\u00a0<\/span>(anesthesia for dental);\u00a0<span class=\"cite\">Section 1367.9\u00a0<\/span>(conditions attributable to diethylstilbestrol);\u00a0<span class=\"cite\">Section 1368.2\u00a0<\/span>(hospice care);\u00a0<span class=\"cite\">Section 1370.6\u00a0<\/span>(cancer clinical trials);\u00a0<span class=\"cite\">Section 1371.5\u00a0<\/span>(emergency response ambulance or ambulance transport services);\u00a0<span class=\"cite\">subdivision (b) of Section 1373\u00a0<\/span>(sterilization operations or procedures);\u00a0<span class=\"cite\">Section 1373.4\u00a0<\/span>(inpatient hospital and ambulatory maternity);\u00a0<span class=\"cite\">Section 1374.56\u00a0<\/span>(phenylketonuria);\u00a0<span class=\"cite\">Section 1374.17\u00a0<\/span>(organ transplants for HIV);\u00a0<span class=\"cite\">Section 1374.72\u00a0<\/span>(mental health parity); and\u00a0<span class=\"cite\">Section 1374.73\u00a0<\/span>(autism\/behavioral health treatment).<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(iii)\u2002Any other benefits mandated to be covered by the plan pursuant to statutes enacted before December 31, 2011, as described in those statutes.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(iv)\u2002The health benefits covered by the plan that are not otherwise required to be covered under this chapter, to the extent required pursuant to\u00a0<span class=\"cite\">Sections 1367.18\u00a0<\/span>,\u00a0<span class=\"cite\">1367.21\u00a0<\/span>,\u00a0<span class=\"cite\">1367.215\u00a0<\/span>,\u00a0<span class=\"cite\">1367.22\u00a0<\/span>,\u00a0<span class=\"cite\">1367.24\u00a0<\/span>, and\u00a0<span class=\"cite\">1367.25\u00a0<\/span>, and\u00a0<span class=\"cite\">Section 1300.67.24 of Title 28 of the California Code of Regulations\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(v)\u2002Any other health benefits covered by the plan that are not otherwise required to be covered under this chapter.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(B)\u2002<span class=\"added-material\">If<\/span>\u00a0there are any conflicts or omissions in the plan identified in subparagraph (A) as compared with the requirements for health benefits under this chapter that were enacted prior to December 31, 2011, the requirements of this chapter shall be controlling, except as otherwise specified in this section.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(C)\u2002Notwithstanding subparagraph (B) or any other provision of this section, the home health services benefits covered under the plan identified in subparagraph (A) shall be deemed to not be in conflict with this chapter.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(D)\u2002For purposes of this section, the Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 (<span class=\"cite\">\u00a0Public Law 110-343\u00a0<\/span>)\u00a0<span class=\"footnote-reference\">\u20092<\/span>\u00a0shall apply to a contract subject to this section. \u2002Coverage of mental health and substance use disorder services pursuant to this paragraph, along with any scope and duration limits imposed on the benefits, shall be in compliance with the Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 (<span class=\"cite\">\u00a0Public Law 110-343\u00a0<\/span>), and all rules, regulations, or guidance issued pursuant to Section 2726 of the federal Public Health Service Act (<span class=\"cite\">\u00a042 U.S.C. Sec. 300gg-26\u00a0<\/span>).<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(3)\u2002With respect to habilitative services, in addition to any habilitative services and devices identified in paragraph (2), coverage shall also be provided as required by federal rules, regulations, and guidance issued pursuant to Section 1302(b) of PPACA. \u2002Habilitative services and devices shall be covered under the same terms and conditions applied to rehabilitative services and devices under the plan contract. \u2002Limits on habilitative and rehabilitative services and devices shall not be combined.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(4)\u2002With respect to pediatric vision care, the same health benefits for pediatric vision care covered under the Federal Employees Dental and Vision Insurance Program vision plan with the largest national enrollment as of the first quarter of 2014. \u2002The pediatric vision care benefits covered pursuant to this paragraph shall be in addition to, and shall not replace, any vision services covered under the plan identified in paragraph (2).<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(5)\u2002With respect to pediatric oral care, the same health benefits for pediatric oral care covered under the dental benefit received by children under the Medi-Cal program as of 2014, including the provision of medically necessary orthodontic care provided pursuant to the federal Children&#8217;s Health Insurance Program Reauthorization Act of 2009. \u2002The pediatric oral care benefits covered pursuant to this paragraph shall be in addition to, and shall not replace, any dental or orthodontic services covered under the plan identified in paragraph (2).<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002Treatment limitations imposed on health benefits described in this section shall be no greater than the treatment limitations imposed by the corresponding plans identified in subdivision (a), subject to the requirements set forth in paragraph (2) of subdivision (a).<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002Except as provided in subdivision (d), nothing in this section shall be construed to permit a health care service plan to make substitutions for the benefits required to be covered under this section, regardless of whether those substitutions are actuarially equivalent.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002To the extent permitted under Section 1302 of PPACA and any rules, regulations, or guidance issued pursuant to that section, and to the extent that substitution would not create an obligation for the state to defray costs for any individual, a plan may substitute its prescription drug formulary for the formulary provided under the plan identified in subdivision (a) as long as the coverage for prescription drugs complies with the sections referenced in clauses (ii) and (iv) of subparagraph (A) of paragraph (2) of subdivision (a) that apply to prescription drugs.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002<span class=\"added-material\">A<\/span>\u00a0health care service plan, or its agent, solicitor, or representative, shall\u00a0<span class=\"added-material\">not<\/span>\u00a0issue, deliver, renew, offer, market, represent, or sell any product, contract, or discount arrangement as compliant with the essential health benefits requirement in federal law, unless it meets all of the requirements of this section.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(f)\u2002This section\u00a0<span class=\"added-material\">applies<\/span>\u00a0regardless of whether the plan contract is offered inside or outside the California Health Benefit Exchange created by\u00a0<span class=\"cite\">Section 100500 of the Government Code\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(g)\u2002<span class=\"added-material\">This<\/span>\u00a0section shall\u00a0<span class=\"added-material\">not<\/span>\u00a0be construed to exempt a plan or a plan contract from meeting other applicable requirements of law.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(h)\u2002This section shall not be construed to prohibit a plan contract from covering additional benefits, including, but not limited to, spiritual care services that are tax deductible under\u00a0<span class=\"cite\">Section 213 of the Internal Revenue Code\u00a0<\/span>.\u00a0<span class=\"footnote-reference\">\u20093<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(i)\u2002Subdivision (a)\u00a0<span class=\"added-material\">does<\/span>\u00a0not apply to any of the following:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002A specialized health care service plan contract.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002A Medicare supplement plan.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(3)\u2002A plan contract that qualifies as a grandfathered health plan under\u00a0<span class=\"cite\">Section 1251\u00a0<\/span>of PPACA\u2009\u00a0<span class=\"footnote-reference\">\u20094<\/span>\u00a0or any rules, regulations, or guidance issued pursuant to that section.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(j)\u2002<span class=\"added-material\">This<\/span>\u00a0section shall\u00a0<span class=\"added-material\">not<\/span>\u00a0be implemented in a manner that conflicts with a requirement of PPACA.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(k)\u2002This section shall be implemented only to the extent essential health benefits are required pursuant to PPACA.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(<i>l<\/i>)\u2002An essential health benefit is required to be provided under this section only to the extent that federal law does not require the state to defray the costs of the benefit.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(m)\u2002<span class=\"added-material\">This<\/span>\u00a0section\u00a0<span class=\"added-material\">does not<\/span>\u00a0obligate the state to incur costs for the coverage of benefits that are not essential health benefits as defined in this section.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(n)\u2002A plan is not required to cover, under this section, changes to health benefits that are the result of statutes enacted on or after December 31, 2011.<\/p>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(<i>o<\/i>)(1)\u2002The department may adopt emergency regulations implementing this section. \u2002The department may, on a one-time basis, readopt any emergency regulation authorized by this section that is the same as, or substantially equivalent to, an emergency regulation previously adopted under this section.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002The initial adoption of emergency regulations implementing this section and the readoption of emergency regulations authorized by this subdivision shall be deemed an emergency and necessary for the immediate preservation of the public peace, health, safety, or general welfare. \u2002The initial emergency regulations and the readoption of emergency regulations authorized by this section shall be submitted to the Office of Administrative Law for filing with the Secretary of State and each shall remain in effect for no more than 180 days, by which time final regulations may be adopted.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(3)\u2002The initial adoption of emergency regulations implementing this section made during the 2015-16 Regular Session of the Legislature and the readoption of emergency regulations authorized by this subdivision shall be deemed an emergency and necessary for the immediate preservation of the public peace, health, safety, or general welfare. \u2002The initial emergency regulations and the readoption of emergency regulations authorized by this section shall be submitted to the Office of Administrative Law for filing with the Secretary of State and each shall remain in effect for no more than 180 days, by which time final regulations may be adopted.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(4)\u2002The director shall consult with the Insurance Commissioner to ensure consistency and uniformity in the development of regulations under this subdivision.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(5)\u2002This subdivision shall become inoperative on July 1, 2018.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(p)\u2002For purposes of this section, the following definitions\u00a0apply:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002\u201c<span class=\"wordphrase\">Habilitative services<\/span>\u201d means health care services and devices that help a person keep, learn, or improve skills and functioning for daily living. \u2002Examples include therapy for a child who is not walking or talking at the expected age. \u2002These services may include physical and occupational therapy, speech-language pathology, and other services for people with disabilities in a variety of inpatient or outpatient settings, or both. \u2002Habilitative services shall be covered under the same terms and conditions applied to rehabilitative services under the plan contract.<\/p>\n<\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)(A)\u2002\u201c<span class=\"wordphrase\">Health benefits<\/span>,\u201d unless otherwise required to be defined pursuant to federal rules, regulations, or guidance issued pursuant to Section 1302(b) of PPACA, means health care items or services for the diagnosis, cure, mitigation, treatment, or prevention of illness, injury, disease, or a health condition, including a behavioral health condition.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(B)\u2002\u201c<span class=\"wordphrase\">Health benefits<\/span>\u201d does not mean any cost-sharing requirements such as copayments, coinsurance, or deductibles.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(3)\u2002\u201c<span class=\"wordphrase\">PPACA<\/span>\u201d means the federal Patient Protection and Affordable Care Act (<span class=\"cite\">\u00a0Public Law 111-148\u00a0<\/span>), as amended by the federal Health Care and Education Reconciliation Act of 2010 (<span class=\"cite\">\u00a0Public Law 111-152\u00a0<\/span>), and any rules, regulations, or guidance issued thereunder.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(4)\u2002\u201c<span class=\"wordphrase\">Small group health care service plan contract<\/span>\u201d means a group health care service plan contract issued to a small employer, as defined in\u00a0<span class=\"cite\">Section 1357.500\u00a0<\/span>.<\/p>\n<\/div>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":9,"featured_media":0,"parent":2019,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-5631","page","type-page","status-publish","hentry"],"yoast_head":"<!--
