class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(a)\u2002The following persons, properly identified, are exempted from the firearm safety certificate requirement in\u00a0<span class=\"cite\">subdivision (a) of Section 31615\u00a0<\/span>:<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002Any active or honorably retired peace officer, as defined in Chapter 4.5 (commencing with\u00a0<span class=\"cite\">Section 830\u00a0<\/span>) of Title 3 of Part 2.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002Any active or honorably retired federal officer or law enforcement agent.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(3)\u2002Any reserve peace officer, as defined in\u00a0<span class=\"cite\">Section 832.6\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(4)\u2002Any person who has successfully completed the course of training specified in\u00a0<span class=\"cite\">Section 832\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(5)\u2002A firearms dealer licensed pursuant to\u00a0<span class=\"cite\">Sections 26700\u00a0<\/span>to\u00a0<span class=\"cite\">26915\u00a0<\/span>, inclusive, who is acting in the course and scope of that person&#8217;s activities as a person licensed pursuant to\u00a0<span class=\"cite\">Sections 26700\u00a0<\/span>to\u00a0<span class=\"cite\">26915\u00a0<\/span>, inclusive.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(6)\u2002A federally licensed collector who is acquiring or being loaned a firearm that is a curio or relic, as defined in\u00a0<span class=\"cite\">Section 478.11 of Title 27 of the Code of Federal Regulations\u00a0<\/span>, who has a current certificate of eligibility issued by the department pursuant to\u00a0<span class=\"cite\">Section 26710\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(7)\u2002A person to whom a firearm is being returned, where the person receiving the firearm is the owner of the firearm.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(8)\u2002A family member of a peace officer or deputy sheriff from a local agency who receives a firearm pursuant to\u00a0<span class=\"cite\">Section 50081 of the Government Code\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(9)\u2002Any individual who has a valid concealed weapons permit issued pursuant to Chapter 4 (commencing with\u00a0<span class=\"cite\">Section 26150\u00a0<\/span>) of Division 5.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(10)\u2002An active or honorably retired member of the United States Armed Forces, the National Guard, the Air National Guard, or the active reserve components of the United States, where individuals in those organizations are properly identified. \u2002For purposes of this section, proper identification includes the Armed Forces Identification Card or other written documentation certifying that the individual is an active or honorably retired member.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(11)\u2002Any person who is authorized to carry loaded firearms pursuant to\u00a0<span class=\"cite\">Section 26025\u00a0<\/span>or\u00a0<span class=\"cite\">26030\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(12)\u2002Persons who are the holders of a special weapons permit issued by the department pursuant to\u00a0<span class=\"cite\">Section 32650\u00a0<\/span>or\u00a0<span class=\"cite\">33300\u00a0<\/span>, pursuant to Article 3 (commencing with\u00a0<span class=\"cite\">Section 18900\u00a0<\/span>) of Chapter 1 of Division 5 of Title 2, or pursuant to Article 4 (commencing with\u00a0<span class=\"cite\">Section 32700\u00a0<\/span>) of Chapter 6 of this division.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002The following persons who take title or possession of a firearm by operation of law in a representative capacity, until or unless they transfer title ownership of the firearm to themselves in a personal capacity, are exempted from the firearm safety certificate requirement in\u00a0<span class=\"cite\">subdivision (a) of Section 31615\u00a0<\/span>:<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002The executor or administrator of an estate.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002A secured creditor or an agent or employee thereof when the firearms are possessed as collateral for, or as a result of,\u00a0a default under a security agreement under the Commercial Code.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(3)\u2002A levying officer, as defined in\u00a0<span class=\"cite\">Section 481.140\u00a0<\/span>,\u00a0<span class=\"cite\">511.060\u00a0<\/span>, or\u00a0<span class=\"cite\">680.260 of the Code of Civil Procedure\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(4)\u2002A receiver performing the functions of a receiver.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(5)\u2002A trustee in bankruptcy performing the duties of a trustee.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(6)\u2002An assignee for the benefit of creditors performing the functions of an assignee.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002A person, validly identified, who has been issued a valid hunting license that is unexpired or that was issued for the hunting season immediately preceding the calendar year in which the person takes title\u00a0<span class=\"added-material\">or<\/span>\u00a0possession of a firearm is exempt from the firearm safety certificate requirement in\u00a0<span class=\"cite\">subdivision (a) of Section 31615\u00a0<\/span>, except as to handguns.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002This section shall become operative on January 1, 2015.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\"
