class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p>(a)\u2002Notwithstanding\u00a0<span class=\"cite\">Sections 20616\u00a0<\/span>,\u00a0<span class=\"cite\">20618\u00a0<\/span>, and\u00a0<span class=\"cite\">20815\u00a0<\/span>, the board may create, combine or eliminate risk pools for local miscellaneous members and local safety members.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002The board shall establish, by regulation, the criteria under which contracting agencies shall participate in a risk pool and the criteria under which contracting agencies, county offices of education, school districts, and community college districts may participate in a risk pool. \u2002The criteria shall specify that county offices of education, school districts, and community college districts may only participate in a risk pool if the retirement formula of the risk pool is higher than the retirement formula applicable to school members. \u2002In determining the criteria, the board shall consider the expected variability of the employer contribution rate due to demographic events. \u2002In no event shall contracting agencies with more than 100 active members in a member classification be required to commence participation in a risk pool for members in that member classification. \u2002For the purpose of this subdivision an active member is a member who is an employee of the contracting agency.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002If a contracting agency, county office of education, school district, or community college district participates in a risk pool, the assets and liabilities with respect to the affected member classification shall be combined with those of the risk pool.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002The board shall establish, by regulation, the circumstances under which a contracting agency may cease participation in a risk pool for a member classification.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002All of the following provisions shall apply, without election by the contracting agency participating in a risk pool, to local members included in a risk pool:<\/p>\n<div class=\"subsection\">\n<p>(1)\u2002<span class=\"cite\">\u00a0Sections 20965\u00a0<\/span>,\u00a0<span class=\"cite\">21022\u00a0<\/span>,\u00a0<span class=\"cite\">21026\u00a0<\/span>,\u00a0<span class=\"cite\">21037\u00a0<\/span>,\u00a0<span class=\"cite\">21536\u00a0<\/span>, and\u00a0<span class=\"cite\">21548\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(2)\u2002Provisions to elect to receive credit for public service pursuant to Article 5 (commencing with\u00a0<span class=\"cite\">Section 21020\u00a0<\/span>) of Chapter 11 that require the member to make the contributions as specified in\u00a0<span class=\"cite\">Sections 21050\u00a0<\/span>and\u00a0<span class=\"cite\">21052\u00a0<\/span>.<\/p>\n<\/div>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr \/>\n<p><a
