class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(a)<\/span>\u2002Except as provided in\u00a0<span class=\"cite\">Section 4005\u00a0<\/span>, nongame mammals and black-tailed jackrabbits, muskrats,\u00a0<span class=\"added-material\">subspecies of red fox that are not the native Sierra Nevada red fox (Vulpes vulpes necator),<\/span>\u00a0and red fox squirrels that are found to be injuring growing crops or other property may be taken at any time or in any manner in accordance with this code\u00a0<span class=\"added-material\">and regulations adopted pursuant to this code<\/span>\u00a0by the owner or tenant of the premises or employees\u00a0<span class=\"added-material\">and agents in immediate possession of written permission from the owner or tenant<\/span>\u00a0thereof. \u2002They may also be taken by officers or employees of the Department of Food and Agriculture or by federal, county, or city\u00a0officers or employees when acting in their official capacities pursuant to\u00a0the Food and Agricultural Code pertaining to pests, or pursuant to Article 6 (commencing with\u00a0<span class=\"cite\">Section 6021) of Chapter 9 of Part 1 of Division 4 of the Food and Agricultural Code\u00a0<\/span>. \u2002Persons taking mammals in accordance with this section are exempt from\u00a0<span class=\"cite\">Section 3007\u00a0<\/span><span class=\"added-material\">, except when providing trapping services for a fee<\/span>. \u2002Raw furs, as defined in\u00a0<span class=\"cite\">Section 4005\u00a0<\/span>, that are taken under this section,\u00a0<span class=\"added-material\">shall<\/span>\u00a0not be sold.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(b)<\/span>\u2002Traps used pursuant to this section shall be inspected and all animals in the\u00a0<span class=\"added-material\">traps<\/span>\u00a0shall be removed at least once daily. \u2002The inspection and removal shall be done by the person who sets the trap or the owner of the land where the trap is set or an agent of either.<\/p>\n<\/div>\n<p><br
