class=\"subsection\"><\/div>\n<div class=\"subsection\">\n<div class=\"subsection\">\n<p><span class=\"added-material\">(a)\u2002Whenever a contract is<\/span>\u00a0awarded under\u00a0<span class=\"added-material\">a procedure providing for competitive bidding, but the contract is not to<\/span>\u00a0be awarded\u00a0<span class=\"added-material\">to the low bidder, the low bidder shall be given notice<\/span>\u00a0five working days\u00a0<span class=\"added-material\">prior to the award of the contract by telegram, electronic facsimile transmission, overnight courier, Internet transmission, or personal delivery<\/span>.<\/p>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(1)\u2002Upon written request by any bidder who has submitted a bid, notice of the proposed award shall be posted in a place accessible by the general public, including any Internet site identified in the invitation for bids at least five working days prior to awarding the contract.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(2)<\/span>\u2002If, prior to the award, any bidder files a protest with the awarding\u00a0<span class=\"added-material\">state agency<\/span>\u00a0and\u00a0<span class=\"added-material\">the<\/span>\u00a0department\u00a0<span class=\"added-material\">protesting the award<\/span>\u00a0of the contract\u00a0<span class=\"added-material\">on the grounds that he or she is the lowest responsible bidder meeting the specifications for the contract<\/span>, the contract shall not be awarded until either the protest has been withdrawn or the department has decided the matter.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(3)<\/span>\u2002Within five days after filing the protest, the protesting bidder shall file with the department and\u00a0<span class=\"added-material\">the<\/span>\u00a0awarding\u00a0<span class=\"added-material\">state<\/span>\u00a0agency a full and complete written statement specifying the grounds for the protest.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(b)\u2002Contracts awarded under the provisions of\u00a0<span class=\"cite\">Section 10344\u00a0<\/span>shall be awarded only after a notice of the proposed award has been posted in a place accessible by the general public, including any Internet site identified in the request for proposal, for five working days.<\/span><\/p>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(1)\u2002If, prior to the award, any bidder files a protest with the awarding state agency and the department against the awarding of the contract, the contract shall not be awarded until either the protest has been withdrawn or the department has decided the matter.<\/span><\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(2)\u2002Within five days after filing the protest, the protesting bidder shall file with the department and awarding state agency a full and complete written statement specifying the grounds for the protest. \u2002Protests shall be limited to the following grounds:<\/span><\/p>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(A)<\/span>\u2002The state agency failed to follow the procedures specified in either\u00a0<span class=\"cite\">subdivision (b)\u00a0<\/span>or\u00a0<span class=\"cite\">(c) of Section 10344\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(B)<\/span>\u2002The\u00a0<span class=\"added-material\">state<\/span>\u00a0agency failed to apply correctly the standards for reviewing the format requirements or evaluating the proposals as specified in the request for proposal.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(C)<\/span>\u2002The state agency used the evaluation and selection procedure in\u00a0<span class=\"cite\">subdivision (b) of Section 10344\u00a0<\/span>, but is proposing to award the contract to a bidder other than the lowest responsible bidder.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(D)<\/span>\u2002The\u00a0<span class=\"added-material\">state<\/span>\u00a0agency used the evaluation and selection procedure in\u00a0<span class=\"cite\">subdivision (c) of Section 10344\u00a0<\/span>, but failed to follow the methods for evaluating and scoring the proposals specified in the request for proposal.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(E)<\/span>\u2002The\u00a0<span class=\"added-material\">state<\/span>\u00a0agency used the evaluation and selection procedure in\u00a0<span class=\"cite\">subdivision (c) of Section 10344\u00a0<\/span>, but is proposing to award the contract to a bidder other than the bidder given the highest score by the\u00a0<span class=\"added-material\">state<\/span>\u00a0agency evaluation committee.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p><span class=\"added-material\">(c)<\/span>\u2002The department shall establish written procedures for deciding protests under this section.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<\/div>\n<\/div>\n<hr
