{"id":677,"date":"2022-03-21T04:53:06","date_gmt":"2022-03-21T04:53:06","guid":{"rendered":"https:\/\/crowdsourcelawyers.com\/statutes-california-laws\/?page_id=677"},"modified":"2022-05-20T23:45:08","modified_gmt":"2022-05-20T23:45:08","slug":"family-code-2030","status":"publish","type":"page","link":"https:\/\/crowdsourcelawyers.com\/california-statutes\/california-statutes\/family-code-2030\/","title":{"rendered":"Family Code 2030"},"content":{"rendered":"<section  class='av_textblock_section av-av_textblock-e878f05c31dff72941bf1e49a00d9ff5 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p>Currrent as of February 4, 2022<\/p>\n<\/div><\/section>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-l108fdgs-69db9f9137a374c22c32f83f6628c2d8\">\n#top .av_textblock_section.av-l108fdgs-69db9f9137a374c22c32f83f6628c2d8 .avia_textblock{\nfont-size:19px;\n}\n<\/style>\n<section  class='av_textblock_section av-l108fdgs-69db9f9137a374c22c32f83f6628c2d8 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><h1>Family Code \u00a7\u20022030<\/h1>\n<h2 class=\"SS_Banner\">Ordering party to pay to ensure other party\u2019s access to legal representation<\/h2>\n<hr \/>\n<p><strong>(a)<\/strong><\/p>\n<p style=\"padding-left: 40px\"><strong>(1)<\/strong> In a proceeding for dissolution of marriage, nullity of marriage, or legal separation of the parties, and in any proceeding subsequent to entry of a related judgment, the court shall ensure that each party has access to legal representation, including access early in the proceedings, to preserve each party\u2019s rights by ordering, if necessary based on the income and needs assessments, one party, except a governmental entity, to pay to the other party, or to the other party\u2019s attorney, whatever amount is reasonably necessary for attorney\u2019s fees and for the cost of maintaining or defending the proceeding during the pendency of the proceeding.<\/p>\n<p style=\"padding-left: 40px\"><strong>(2)<\/strong> When a request for attorney\u2019s fees and costs is made, the court shall make findings on whether an award of attorney\u2019s fees and costs under this section is appropriate, whether there is a disparity in access to funds to retain counsel, and whether one party is able to pay for legal representation of both parties. If the findings demonstrate disparity in access and ability to pay, the court shall make an order awarding attorney\u2019s fees and costs. A party who lacks the financial ability to hire an attorney may request, as an in pro per litigant, that the court order the other party, if that other party has the financial ability, to pay a reasonable amount to allow the unrepresented party to retain an attorney in a timely manner before proceedings in the matter go forward.<\/p>\n<p><strong>(b)<\/strong> Attorney\u2019s fees and costs within this section may be awarded for legal services rendered or costs incurred before or after the commencement of the proceeding.<\/p>\n<p><strong>(c)<\/strong> The court shall augment or modify the original award for attorney\u2019s fees and costs as may be reasonably necessary for the prosecution or defense of the proceeding, or any proceeding related thereto, including after any appeal has been concluded.<\/p>\n<p><strong>(d)<\/strong> Any order requiring a party who is not the spouse of another party to the proceeding to pay attorney\u2019s fees or costs shall be limited to an amount reasonably necessary to maintain or defend the action on the issues relating to that party.<\/p>\n<p><strong>(e)<\/strong> The Judicial Council shall, by January 1, 2012, adopt a statewide rule of court to implement this section and develop a form for the information that shall be submitted to the court to obtain an award of attorney\u2019s fees under this section.<\/p>\n<hr \/>\n<p><strong>History<\/strong><\/p>\n<p>Added Stats 1993 ch 219 \u00a7 106.1 (AB 1500).
