{"id":702,"date":"2022-03-21T05:01:52","date_gmt":"2022-03-21T05:01:52","guid":{"rendered":"https:\/\/crowdsourcelawyers.com\/statutes-california-laws\/?page_id=702"},"modified":"2022-05-20T23:45:08","modified_gmt":"2022-05-20T23:45:08","slug":"evidence-code-403","status":"publish","type":"page","link":"https:\/\/crowdsourcelawyers.com\/california-statutes\/california-statutes\/evidence-code-403\/","title":{"rendered":"Evidence Code 403"},"content":{"rendered":"<section  class='av_textblock_section av-av_textblock-e878f05c31dff72941bf1e49a00d9ff5 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><p>Currrent as of February 4, 2022<\/p>\n<\/div><\/section>\n\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\" id=\"style-css-av-l108qm56-ce1658b2846d21a0208405b61134d631\">\n#top .av_textblock_section.av-l108qm56-ce1658b2846d21a0208405b61134d631 .avia_textblock{\nfont-size:19px;\n}\n<\/style>\n<section  class='av_textblock_section av-l108qm56-ce1658b2846d21a0208405b61134d631 '   itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock'  itemprop=\"text\" ><h1>Evidence Code \u00a7\u2002403<\/h1>\n<h2 class=\"SS_Banner\">Determination of foundational and other preliminary facts where relevancy, personal knowledge, or authenticity is disputed<\/h2>\n<hr \/>\n<p><strong>(a)<\/strong> The proponent of the proffered evidence has the burden of producing evidence as to the existence of the preliminary fact, and the proffered evidence is inadmissible unless the court finds that there is evidence sufficient to sustain a finding of the existence of the preliminary fact, when:<\/p>\n<p style=\"padding-left: 40px\"><strong>(1)<\/strong> The relevance of the proffered evidence depends on the existence of the preliminary fact;<\/p>\n<p style=\"padding-left: 40px\"><strong>(2)<\/strong> The preliminary fact is the personal knowledge of a witness concerning the subject matter of his testimony;<\/p>\n<p style=\"padding-left: 40px\"><strong>(3)<\/strong> The preliminary fact is the authenticity of a writing; or<\/p>\n<p style=\"padding-left: 40px\"><strong>(4)<\/strong> The proffered evidence is of a statement or other conduct of a particular person and the preliminary fact is whether that person made the statement or so conducted himself.<\/p>\n<p><strong>(b)<\/strong> Subject to Section 702, the court may admit conditionally the proffered evidence under this section, subject to evidence of the preliminary fact being supplied later in the course of the trial.<\/p>\n<p><strong>(c)<\/strong> If the court admits the proffered evidence under this section, the court:<\/p>\n<p style=\"padding-left: 40px\"><strong>(1)<\/strong> May, and on request shall, instruct the jury to determine whether the preliminary fact exists and to disregard the proffered evidence unless the jury finds that the preliminary fact does exist.<\/p>\n<p style=\"padding-left: 40px\"><strong>(2)<\/strong> Shall instruct the jury to disregard the proffered evidence if the court subsequently determines that a jury could not reasonably find that the preliminary fact exists.<\/p>\n<p style=\"padding-left: 40px\">\n<hr \/>\n<p><strong>History<\/strong><\/p>\n<p>Enacted Stats 1965 ch 299 \u00a7\u20022, operative January 1, 1967.<\/p>\n<hr \/>\n<p>Evidence Code 403<\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":3,"featured_media":0,"parent":2019,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-702","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
