Public health: amusement parks and COVID-19.<\/p>\n<p>Existing law, the California Emergency Services Act, authorizes the Governor to declare a state of emergency during conditions of disaster or extreme peril to persons or property, including epidemics. Pursuant to this authority, on March 4, 2020, the Governor declared a state of emergency relating to the novel coronavirus 2019 (COVID-19) pandemic. On August 28, 2020, the executive branch implemented a 4-tier \u201cBlueprint for a Safer Economy,\u201d which identifies a county\u2019s COVID-19 risk level for business operations on a scale from widespread risk to minimal risk. On October 20, 2020, the State Department of Public Health and the Division of Occupational Safety and Health issued a guidance document, \u201cCOVID-19 INDUSTRY GUIDANCE: Amusement Parks and Theme Parks,\u201d which authorizes a small amusement park to operate at limited capacity when its county is in the moderate tier, and authorizes any other amusement park to operate at 25% capacity when its county is in the minimal tier.<\/p>\n<p>This bill would express the intent of the Legislature that the executive branch adjust the \u201cCOVID-19 INDUSTRY GUIDANCE: Amusement Parks and Theme Parks\u201d document and place all amusement parks, regardless of size, within the moderate risk tier, rather than the minimal risk tier.\u00a0If the executive branch takes those actions, the bill would require the Department of Industrial Relations to administer a competitive grant for amusement parks to be used by amusement parks to purchase personal protective equipment for their employees. The bill would appropriate $500,000 from the General Fund for the grant program.\u00a0The bill would also make related findings and declarations.<\/p>\n<p>Vote:\u00a02\/3\u00a0\u00a0\u00a0Appropriation:\u00a0yes\u00a0\u00a0\u00a0Fiscal Committee:yes\u00a0\u00a0\u00a0Local Program:\u00a0no<\/p>\n<hr \/>\n<p>THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:<\/p>\n<p><strong>SECTION 1.<\/strong><\/p>\n<p>The Legislature finds and declares all of the following:<\/p>\n<p>(a)\u00a0The prolonged COVID-19-related closures of California\u2019s amusement parks are having devastating impacts on tens of thousands of furloughed and laid off amusement park employees, the businesses and communities surrounding amusement parks, and the local governments dependent on the parks.<\/p>\n<p>(b)\u00a0While dealing with the public health crisis caused by the COVID-19 pandemic remains paramount, grave concerns related to personal financial health, as well as physical, mental, and behavioral health, have arisen as a result of the amusement park closures.<\/p>\n<p>(c)\u00a0California\u2019s amusement parks, large and small, are a vital sector in California\u2019s economy. In 2018, the International Association of Amusement Parks and Attractions estimated that California\u2019s amusement parks support more than 143,000 jobs statewide and provide over $2.7 billion in annual employee compensation.<\/p>\n<p>(d)\u00a0California\u2019s amusement parks contribute heavily to the economic stability of state and local governments, generating $12.6 billion in direct and indirect revenue impact to the state and paying approximately $1.5 billion annually in federal, state, and local taxes.<\/p>\n<p>(e)\u00a0At the beginning of the COVID-19 pandemic in March 2020, California\u2019s amusement parks voluntarily closed and immediately began consulting industry and health experts to develop comprehensive reopening plans consisting of reduced capacity, physical distancing and face covering requirements, robust health and safety protocols for employees and guests, heightened sanitation processes, physical and operational modifications, and enhanced signage throughout their parks.<\/p>\n<p>(f)\u00a0Amusement parks in other states and in other countries have successfully reopened and currently there are no known COVID-19 outbreaks that have been traced back to the parks. As noted in the New York Times, \u201cAt Disney World, \u2018Worst Fears\u2019 About Virus Have Not Come True: Attendance has been low since the July reopening, but health officials and worker unions also say safety protocols have kept the coronavirus at bay.\u201d<\/p>\n<p>(g)\u00a0Public health officials in California and in other states consistently cite household gatherings, household transmissions, and congregate settings as being primary sources of outbreaks, but none have presented scientific evidence or data pointing to amusement parks as an activity bearing a high risk of transmission.<\/p>\n<p>(h)\u00a0The executive branch released its \u201cBlueprint for a Safer Economy\u201d on August 28, 2020, inclusive of the four-tier system for counties, and subsequently released the guidance document for amusement and theme parks on October 20, 2020.<\/p>\n<p>(i)\u00a0Within the Blueprint, many activities similar to amusement parks, such as museums, zoos, aquariums, family entertainment centers, outdoor recreation, and outdoor malls are allowed to reopen in varying degrees within the first three tiers. However, the executive branch placed California\u2019s larger amusement parks in Yellow \u2013 Minimal \u2013 Tier 4, indicative of minimal spread of COVID-19 and characterized as the least restrictive tier under which \u201cmost indoor business operations are open with modifications.\u201d<\/p>\n<p>(j)\u00a0Certain other activities with fewer controls and bearing greater risk of COVID-19 transmission either lack restrictions or are allowed to reopen ahead of amusement parks, such as beaches, state parks, indoor malls, card rooms and racetracks, and professional sporting events at stadiums with live audiences.<\/p>\n<p>(k)\u00a0Amusement parks can provide a safer environment for families and individuals to spend leisure time than many other places that are operating without the same degree of crowd control, physical distancing, and safety protocols.<\/p>\n<p>(l)\u00a0California\u2019s amusement parks have historically made guest and employee health, safety, and satisfaction top priorities. They are controlled environments operating primarily outdoors. Amusement parks are in the business of moving people and can do so in a way that monitors physical distancing. Exposure time is limited at amusement parks, given guest movement and that an amusement park is able to adjust its capacity in real time to allow for appropriate distancing throughout the property.<\/p>\n<p>(m)\u00a0California state health officials are unable to provide projections for counties that are home to California\u2019s amusement parks to reach Yellow \u2013 Minimal \u2013 Tier 4 and the state\u2019s amusement parks have not been provided a reasonable timeline for resuming operations.<\/p>\n<p><strong>SEC. 2.<\/strong><\/p>\n<p>It is the intent of the Legislature that the executive branch do both of the following:<\/p>\n<p>(a)\u00a0Adjust the \u201cCOVID-19 INDUSTRY GUIDANCE: Amusement Parks and Theme Parks\u201d issued on October 20, 2020.<\/p>\n<p>(b)\u00a0Place all amusement parks, regardless of size, within \u201cOrange \u2013 Moderate \u2013 Tier 3\u201d instead of in \u201cYellow \u2013 Minimal \u2013 Tier 4.\u201d<\/p>\n<p><strong>SEC. 3.<\/strong><\/p>\n<p>Section 65 is added to the Labor Code, immediately following Section 64.5, to read:<\/p>\n<p><strong>65.<\/strong><\/p>\n<p>(a)\u00a0If the executive branch adjusts the \u201cCOVID-19 INDUSTRY GUIDANCE: Amusement Parks and Theme Parks\u201d issued on October 20, 2020, and places all amusement parks, regardless of size, within \u201cOrange \u2013 Moderate \u2013 Tier 3\u201d instead of in \u201cYellow \u2013 Minimal \u2013 Tier 4,\u201d the Department of Industrial Relations shall administer a competitive grant for amusement parks to be used by amusement parks to purchase personal protective equipment for their employees.<\/p>\n<p>(b)\u00a0Five hundred thousand dollars ($500,000) is hereby appropriated from the General Fund to fund the personal protective equipment grant program pursuant to subdivision (a).<\/p>\n<p>(c)\u00a0For purposes of this section:<\/p>\n<p>(1)\u00a0\u201cAmusement park\u201d means a theme park or other facility to which the \u201cCOVID-19 INDUSTRY GUIDANCE: Amusement Parks and Theme Parks\u201d document applies.<\/p>\n<p>(2)\u00a0\u201cPersonal protective equipment\u201d means protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, including N95 and other filtering facepiece respirators, elastomeric air-purifying respirators with appropriate particulate filters or cartridges, powered air-purifying respirators, disinfecting and sterilizing devices and supplies, medical gowns and apparel, face masks, surgical masks, face shields, gloves, shoe coverings, and the equipment identified by or otherwise necessary to comply with Section 5199 of Title 8 of the California Code of Regulations.<\/p>\n<hr \/>\n<p>Assembly Bill 420<\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":3,"featured_media":0,"parent":2019,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-864","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
