[he\/she\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] has not violated [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s right of privacy because the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert type of work, e.g., \u201cpicture\u201d<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] is protected by the\u00a0First Amendment\u2019s\u00a0guarantee of freedom of speech and expression. To succeed, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove either of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert type of work, e.g., \u201cpicture\u201d<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] adds something new to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s likeness, giving it a new expression, meaning, or message; or<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That the value of the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert type of work, e.g., \u201cpicture\u201d<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] does not result primarily from [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s fame. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003; Revised October 2008 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>This instruction assumes that the plaintiff is the celebrity whose likeness is the subject of the trial. This instruction will need to be modified if the plaintiff is not the actual celebrity. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn sum, when an artist is faced with a right of publicity challenge to his or her work, he or she may raise as affirmative defense that the work is protected by the\u00a0First Amendment\u00a0inasmuch as it contains significant transformative elements or that the value of the work does not derive primarily from the celebrity\u2019s fame.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Comedy III Productions, Inc. v. Gary Saderup, Inc.<\/span>\u00a0(2001) 25 Cal.4th 387, 407 [106 Cal.Rptr.2d 126, 21 P.3d 797].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWe have explained that \u2018[o]nly if [a defendant] is entitled to the [transformative] defense\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">as a matter of law<\/span>\u00a0can it prevail on its motion to strike,\u2019 because the California Supreme Court \u2018envisioned the application of the defense as a question of fact.\u2019 As a result, [defendant] \u2018is only entitled to the defense as a matter of law if no trier of fact could reasonably conclude that the [game] [i]s not transformative.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Keller v. Elec. Arts Inc. (In re NCAA Student-Athlete Name &amp; Likeness Licensing Litig.)<\/span>\u00a0(9th Cir. 2013) 724 F.3d 1268, 1274, original italics.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[C]ourts can often resolve the question as a matter of law simply by viewing the work in question and, if necessary, comparing it to an actual likeness of the person or persons portrayed. Because of these circumstances, an action presenting this issue is often properly resolved on summary judgment or, if the complaint includes the work in question, even demurrer.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Winter v. DC Comics<\/span>\u00a0(2003) 30 Cal.4th 881, 891\u2013892 [134 Cal.Rptr.2d 634, 69 P.3d 473], internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he\u00a0First Amendment\u00a0\u2026 safeguards the storytellers and artists who take the raw materials of life\u2014including the stories of real individuals, ordinary or extraordinary\u2014and transform them into art, be it articles, books, movies, or plays.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">De Havilland v. FX Networks, LLC<\/span>\u00a0(2018) 21 Cal.App.5th 845, 860 [230 Cal.Rptr.3d 625].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAlthough surprisingly few courts have considered in any depth the means of reconciling the right of publicity and the\u00a0First Amendment, we follow those that have in concluding that depictions of celebrities amounting to little more than the appropriation of the celebrity\u2019s economic value are not protected expression under the\u00a0First Amendment.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Comedy III Productions, Inc., supra,<\/span>\u00a025 Cal.4th at p. 400.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cFurthermore, in determining whether a work is sufficiently transformative, courts may find useful a subsidiary inquiry, particularly in close cases: does the marketability and economic value of the challenged work derive primarily from the fame of the celebrity depicted? If this question is answered in the negative, then there would generally be no actionable right of publicity. When the value of the work comes principally from some source other than the fame of the celebrity\u2014from the creativity, skill, and reputation of the artist\u2014it may be presumed that sufficient transformative elements are present to warrant\u00a0First Amendment\u00a0protection. If the question is answered in the affirmative, however, it does not necessarily follow that the work is without\u00a0First Amendment\u00a0protection\u2014it may still be a transformative work.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Comedy III Productions, Inc., supra,<\/span>\u00a025 Cal.4th at p. 407.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAs the Supreme Court has stated, the central purpose of the inquiry into this fair use factor \u2018is to see \u2026 whether the new work merely \u201csupersede[s] the objects\u201d of the original creation, or instead adds something new, with a further purpose or different character, altering the first with new expression, meaning, or message; it asks, in other words, whether and to what extent the new work is \u201ctransformative.\u201d\u2009\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Comedy III Productions, Inc., supra,<\/span>\u00a025 Cal.4th at p. 404, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWe emphasize that the transformative elements or creative contributions that require\u00a0First Amendment\u00a0protection are not confined to parody and can take many forms, from factual reporting to fictionalized portrayal, from heavy-handed lampooning to subtle social criticism.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Comedy III Productions, Inc., supra,<\/span>\u00a025 Cal.4th at p. 406.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[Defendant] contends the plaintiffs\u2019 claims are barred by the transformative use defense formulated by the California Supreme Court in\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Comedy III<\/span>\u00a0\u2026\u2009. \u2018The defense is \u201ca balancing test between the\u00a0First Amendment\u00a0and the right of publicity based on whether the work in question adds significant creative elements so as to be transformed into something more than a mere celebrity likeness or imitation.\u201d\u2009\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Davis v. Elec. Arts, Inc.<\/span>\u00a0(9th Cir. 2015) 775 F.3d 1172, 1177, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cSimply stated, the transformative test looks at \u2018whether the celebrity likeness is one of the \u201craw materials\u201d from which an original work is synthesized, or whether the depiction or imitation of the celebrity is the very sum and substance of the work in question. We ask, in other words, whether a product containing a celebrity\u2019s likeness is so transformed that it has become primarily the defendant\u2019s own expression rather than the celebrity\u2019s likeness.\u2019 This transformative test is the court\u2019s primary inquiry when resolving a conflict between the right of publicity and the\u00a0First Amendment.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Ross v. Roberts<\/span>\u00a0(2013) 222 Cal.App.4th 677, 686 [166 Cal.Rptr.3d 359], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Comedy III\u2019s<\/span>\u00a0\u2018transformative\u2019 test makes sense when applied to products and merchandise\u2014\u2018tangible personal property,\u2019 in the Supreme Court\u2019s words. Lower courts have struggled mightily, however, to figure out how to apply it to expressive works such as films, plays, and television programs.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">De Havilland, supra,\u00a0<\/span>21 Cal.App.5th at p. 863, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe\u00a0First Amendment\u00a0defense does not apply only to visual expressions, however. \u2018The protections may extend to all forms of expression, including written and spoken words (fact or fiction), music, films, paintings, and entertainment, whether or not sold for a profit.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Ross<\/span>,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">supra<\/span>, 222 Cal.App.4th at p. 687.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe distinction between parody and other forms of literary expression is irrelevant to the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Comedy III<\/span>\u00a0transformative test. It does not matter what precise literary category the work falls into.
