class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] has proved [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">\/its] claim against [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">], you also must decide how much money will reasonably compensate [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" This compensation is called \u201cdamages.\u201d<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove the amount of [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">\/its] damages. You must not speculate or guess in awarding damages.<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">The following are the specific items of damages claimed by [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">The difference between the fair market value of the property at the time of sale and [the amount that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] received] [or] [the fair market value of what [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] received in exchange for the property];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Amounts that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] reasonably spent in reliance on [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s [false representation\/failure to disclose\/promise] if those amounts would not otherwise have been spent in the sale or exchange of the property;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Loss of use and enjoyment of the property from [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert beginning date<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert end date<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">], to the extent that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s [false representation\/failure to disclose\/promise] was a substantial factor in causing that loss of use and enjoyment of the property;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">4.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Profits or other gains from [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert beginning date<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert end date<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">], that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] might reasonably have earned by use of the property if [he\/she\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] had kept it; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">5.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Any additional damage arising from the particular transaction. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>This instruction should be tailored to fit the facts and evidence in the particular case: \u201cIf the seller parts with title and elects to forego his right of rescission and sue for damages only, then of course subdivisions (a)(2) and (a)(3) of section 3343 do not apply and should not be given by the trial court (unless, as here, the contract itself creates such rights). In each case in which a seller of property is defrauded by a buyer, the trial court will have to examine the circumstances of the particular case and decide whether the questioned portions of section 3343 do or do not apply.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Channell v. Anthony<\/span>\u00a0(1976) 58 Cal.App.3d 290, 317 [129 Cal.Rptr. 704].)<\/p>\n<p>The first element of this instruction should be modified in cases involving promissory fraud: \u201cIn cases of promissory fraud, the damages are measured by market value as of the date the promise was breached because that is the date when the damage occurred.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Glendale Fed. Sav. &amp; Loan Assn. v. Marina View Heights Dev. Co.<\/span>\u00a0(1977) 66 Cal.App.3d 101, 145\u2013146 [135 Cal.Rptr. 802].)<\/p>\n<p>For an instruction on lost profits, see\u00a0CACI No.\u20023903N,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Lost Profits (Economic Damage). <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Fraud in Sale of Property: Seller\u2019s Damages.\u00a0Civil Code section 3343.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAs they apply to damages for fraud, subdivisions (a)(2) and (a)(3) of section 3343 are limited to recovery of damages by sellers of real property, while subdivision (a)(4) deals with purchasers of real property.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Channell, supra,<\/span>\u00a058 Cal.App.3d at p. 309, footnote omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cBefore 1935 the California courts had no statutory mandate on the measure of damages for fraud. While the \u2018benefit of the bargain\u2019 measure of damages was generally employed, on occasion California courts sometimes applied the \u2018out of pocket\u2019 rule when the \u2018loss of bargain\u2019 rule was difficult to apply or would work a hardship on plaintiff or defendant.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Channell, supra,<\/span>\u00a058 Cal.App.3d at p. 309, footnote omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe 1971 amendment to section 3343 took the form of an addition to the \u2018out of pocket\u2019 rule. The statute had previously permitted recovery of \u2018additional damages,\u2019 but the 1971 amendment enumerated specific types of consequential damages which are included within the term \u2018additional damages.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Channell, supra,<\/span>\u00a058 Cal.App.3d at p. 312, footnote omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he legislature clearly ruled out by the 1971 amendment any recovery of damages for fraud measured by the traditional \u2018loss of bargain\u2019 formula.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Channell, supra,<\/span>\u00a058 Cal.App.3d at p. 313, footnote omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[O]ut of pocket\u201d loss under section 3343 is \u201cthe difference between what [plaintiffs] received for their property and the fair market value of the same at the time of the transfer.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Channell, supra,<\/span>\u00a058 Cal.App.3d at p. 314.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[N]othing in section 3343 as amended \u2026 requires that a plaintiff show \u2018out-of-pocket\u2019 loss (i.e., an amount by which the consideration paid exceeded the value of the property received) in order to be entitled to any recovery for fraud in a property transaction.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Stout v. Turney<\/span>\u00a0(1978) 22 Cal.3d 718, 730 [150 Cal.Rptr. 637, 586 P.2d 1228].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn the absence of a fiduciary relationship, section 3343 governs the measure of damages in fraudulent property transactions.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Croeni v. Goldstein<\/span>\u00a0(1994) 21 Cal.App.4th 754, 759 [26 Cal.Rptr.2d 412].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn the case of a seller \u2026 the defrauded victim is entitled to recover not only the difference between the actual value of that with which he parted and the actual value of that which he received (out-of-pocket) but also any additional damage arising from the particular transaction including any of the following: 1. amounts expended in reliance upon the fraud; 2. amounts compensating for loss of use and enjoyment of the property due to the fraud; and 3. an amount which would compensate him for the profits or other gains by the use of the property had he retained it.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Channell, supra,<\/span>\u00a058 Cal.App.3d at p. 312, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWhat that time span [for damages for lost use and lost profits] should be would be determined by the peculiar circumstances of the particular case before the court and should present no insurmountable difficulty for a court in fixing a reasonable period contemplated by the statute.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Channell, supra,<\/span>\u00a058 Cal.App.3d at p. 317, footnote omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cTo recover damages for fraud, a plaintiff must have sustained damages proximately caused by the misrepresentation. A damage award for fraud will be reversed where the injury is not related to the misrepresentation.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Las Palmas Associates v.
