plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] has proved [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">\/its] claim against [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">], you also must decide how much money will reasonably compensate [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span Sav. &amp; Loan Assn. v. Marina View Heights Dev. Co.<\/span>\u00a0(1977) 66 Cal.App.3d 101, 145\u2013146 [135 Cal.Rptr. 802].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Fraud in Sale of Property: Buyer\u2019s Damages.\u00a0Civil Code section 3343.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAs they apply to damages for fraud, subdivisions (a)(2) and (a)(3) of section 3343 are limited to recovery of damages by sellers of real property, while subdivision (a)(4) deals with purchasers of real property.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Channell v. Anthony<\/span>\u00a0(1976) 58 Cal.App.3d 290, 309 [129 Cal.Rptr. 704], footnote omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cBefore 1935 the California courts had no statutory mandate on the measure of damages for fraud. While the \u2018benefit of the bargain\u2019 measure of damages was generally employed, on occasion California courts sometimes applied the \u2018out of pocket\u2019 rule when the \u2018loss of bargain\u2019 rule was difficult to apply or would work a hardship on plaintiff or defendant.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Channell, supra,<\/span>\u00a058 Cal.App.3d at p. 309.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWe find nothing in section 3343 as amended which requires that a plaintiff show \u2018out-of-pocket\u2019 loss (i.e., an amount by which the consideration paid exceeded the value of the property received) in order to be entitled to any recovery for fraud in a property transaction.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Stout v. Turney<\/span>\u00a0(1978) 22 Cal.3d 718, 729 [150 Cal.Rptr. 637, 586 P.2d 1228].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAll doubt concerning this matter was set at rest, however, in the carefully considered opinion in\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Bagdasarian v. Gragnon<\/span>\u00a0(1948) 31 Cal.2d 744, 753 [192 P.2d 935]\u00a0where it was definitely and finally determined that the term \u2018actual value,\u2019 as used in the statute, was that same market value so frequently defined in actions for condemnation.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Nece v. Bennett<\/span>\u00a0(1963) 212 Cal.App.2d 494, 497 [28 Cal.Rptr. 117], internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[P]ursuant to\u00a0Civil Code section 3343, amounts paid for escrow fees, moving to and from the property, building permits, telephone connections, fences, yard cleaning, garage materials, door locks, shrubbery, taxes, rent and labor are examples of recoverable damages when reasonably expended in reliance on the fraud.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Cory v. Villa Properties<\/span>\u00a0(1986)\u00a0180 Cal.App.3d 592, 603 [225 Cal.Rptr. 628], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cTo recover damages for fraud, a plaintiff must have sustained damages proximately caused by the misrepresentation. A damage award for fraud will be reversed where the injury is not related to the misrepresentation.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Las Palmas Associates v.
