data-housestyle=\"EMPHASIS_bf\">] claims that it does not have to pay the [judgment against\/settlement by] [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] because it did not receive timely notice of the [lawsuit\/[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert other<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]]. To succeed, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove both of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] did not give [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] notice [or that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] did not receive notice by some other means] [within the time specified in the policy\/within a reasonable time] of the [lawsuit\/[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert other<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]]; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was prejudiced by [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s failure to give timely notice.<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">To establish prejudice, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must show a substantial likelihood that, with timely notice, it would have [taken steps that would have substantially reduced or eliminated [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s liability] [or] [settled for a substantially smaller amount]. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>The instructions in this series assume the plaintiff is the insured and the defendant is the insurer. The party designations may be changed if appropriate to the facts of the case.<\/p>\n<p>This instruction is intended for use by an insurer as a defense to a breach of contract action based on a third party liability policy. The defense does not apply to \u201cclaims made\u201d policies (see\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Pacific Employers Insurance Co. v. Superior Court<\/span>\u00a0(1990) 221 Cal.App.3d 1348, 1357\u20131360 [270 Cal.Rptr. 779]). This instruction also may be modified for use as a defense to a judgment creditor\u2019s action to recover on a liability policy. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe right of an injured party to sue an insurer on the policy after obtaining judgment against the insured is established by statute. An insurer may assert defenses based upon a breach by the insured of a condition of the policy such as a cooperation clause, but the breach cannot be a valid defense unless the insurer was substantially prejudiced thereby. Similarly, it has been held that prejudice must be shown with respect to breach of a notice clause.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Campbell v. Allstate Insurance Co.<\/span>\u00a0(1963) 60 Cal.2d 303, 305\u2013306 [32 Cal.Rptr. 827, 384 P.2d 155], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe burden of establishing prejudice is on the insurance company, and prejudice is not presumed by delay alone. To establish prejudice, the \u2018\u2009\u201cinsurer must show it lost something that would have changed the handling of the underlying claim.\u201d\u2009\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Lat v. Farmers New World Life Ins. Co.<\/span>\u00a0(2018) 29 Cal.App.5th 191, 196\u2013197 [239 Cal.Rptr.3d 796], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[P]rejudice is not shown simply by displaying end results; the probability that such result could or would have been avoided absent the claimed default or error must also be explored.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Clemmer v. Hartford Insurance Co.<\/span>\u00a0(1978) 22 Cal.3d 865, 883, fn. 12 [151 Cal.Rptr. 285, 587 P.2d 1098].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cPrejudice is a question of fact on which the insurer has the burden of proof. The insured\u2019s delay does not itself satisfy the burden of proof. The insurer establishes actual and substantial prejudice by proving more than delayed or late notice. It must show \u2018\u2009\u201ca substantial likelihood that, with timely notice, and notwithstanding a denial of coverage or reservation of rights, it would have settled the claim for less or taken steps that would have reduced or eliminated the insured\u2019s liability.\u201d\u2009\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Pitzer College v. Indian Harbor Ins. Co.<\/span>\u00a0(2019) 8 Cal.5th 93, 105 [251 Cal.Rptr.3d 701, 447 P.3d 669].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIf the insurer asserts that the underlying claim is not a covered occurrence or is excluded from basic coverage, then earlier notice would only result in earlier denial of coverage. To establish actual prejudice, the insurer must show a substantial likelihood that, with timely notice, and notwithstanding a denial of coverage or reservation of rights, it would have settled the claim for less or taken steps that would have reduced or eliminated the insured\u2019s liability.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Safeco Ins. Co. of America v. Parks<\/span>\u00a0(2009) 170 Cal.App.4th 992, 1004 [88 Cal.Rptr.3d 730].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cUnder the notice prejudice rule, an insurance company may not deny an insured\u2019s claim under an occurrence policy based on lack of timely notice or proof of claim unless it can show actual prejudice from the delay. The rule is based on the rationale that \u2018\u2009\u201c[t]he primary and essential part of the contract [is] insurance coverage, not the procedure for determining liability \u2026\u201d [citations], and that \u201cthe notice requirement serves to protect insurers from prejudice,\u2009\u2026 not \u2026 to shield them from their contractual obligations\u201d through \u201ca technical escape-hatch\u201d.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Lat, supra<\/span>, 29 Cal.App.5th at p. 196, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[The notice-prejudice rule] does not apply to every time limit on any insurance policy. [\u00b6] Where the policy provides that special coverage for a particular type of claim is conditioned on express compliance with a reporting requirement, the time limit is enforceable without proof of prejudice. Such reporting time limits often are found in provisions for expanded liability coverage that the insurer usually does not cover. The insurer makes an exception and extends special coverage conditioned on compliance with a reporting requirement and other conditions. The reporting requirement becomes \u2018the written notice necessary to trigger the expanded coverage afforded\u2019 by the special policy provision.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Venoco, Inc. v. Gulf Underwriters Ins. Co.<\/span>\u00a0(2009) 175 Cal.App.4th 750, 760 [96 Cal.Rptr.3d 409], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWith respect to notice provisions, one Court of Appeal has explained: \u2018[A]n \u201coccurrence\u201d policy provides coverage for any acts or omissions that arise during the policy period even though the claim is made after the policy has expired.\u2019 \u2026 [\u00b6] \u2026 [\u00b6] Occurrence policies were developed to provide coverage for damage caused by collision, fire, war, and other identifiable events.\u2009\u2026 Because the occurrence of these events was relatively easy to ascertain, the insurer was able to \u2018conduct a prompt investigation of the incident \u2026\u2009.\u2019 \u2026 Notice provisions contained in such occurrence policies were \u2018included to aid the insurer in investigating, settling, and defending claims[.]\u2019 \u2026 If an insured breaches a notice provision, resulting in substantial prejudice to the defense, the insurer is relieved of liability.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Belz v. Clarendon America Ins. Co.<\/span>\u00a0(2007) 158 Cal.App.4th 615, 626 [69 Cal.Rptr.3d 864], internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe \u2018general rule\u2019 is that an insurer is not bound by a judgment unless it had notice of the pendency of the action.\u2009\u2026 However, if an insurer denies coverage to the insured, the insured\u2019s contractual obligation to notify the insurer ceases.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Samson v.
