The party designations may be changed if appropriate to the facts of the case.<\/p>\n<p>For general tort instructions, including the definition of \u201csubstantial factor,\u201d see the Negligence series (CACI No.\u2002400\u00a0et seq.). <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cCalifornia recognizes the general rule that an agent or broker who intentionally or negligently fails to procure insurance as requested by a client\u2014either an insured or an applicant for insurance\u2014will be liable to the client in tort for the resulting damages.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">AMCO Ins. Co. v. All Solutions Ins. Agency, LLC<\/span>\u00a0(2016) 244 Cal.App.4th 883, 890 [198 Cal.Rptr.3d 687].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cA \u2018failure to deliver the agreed-upon coverage\u2019 case is actionable \u2026\u2009. An insurance agent has an \u2018obligation to use reasonable care, diligence, and judgment in procuring insurance requested by an insured.\u2019 A broker\u2019s failure to obtain the type of insurance requested by an insured may constitute actionable negligence and the proximate cause of injury.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Desai v. Farmers Insurance Exchange<\/span>\u00a0(1996) 47 Cal.App.4th 1110, 1119\u20131120 [55 Cal.Rptr.2d 276], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAbsent some notice or warning, an insured should be able to rely on an agent\u2019s representations of coverage without independently verifying the accuracy of those representations by examining the relevant policy provisions.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Clement v. Smith<\/span>\u00a0(1993) 16 Cal.App.4th 39, 45 [19 Cal.Rptr.2d 676].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[W]hile an insurance agent who promises to procure insurance will indeed be liable for his negligent failure to do so, it does not follow that he can avoid liability for foreseeable harm caused by his silence or inaction merely because he has not expressly promised to assume responsibility.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Westrick v.
