Five Points Motors, Inc.<\/span>\u00a0(1967) 249 Cal.App.2d 560, 562 [57 Cal.Rptr. 516].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">In appropriate circumstances, the court may authorize the trier of fact to \u201cconsider the probability the employee would exercise the option in determining the length of the unexpired term of employment when applying the applicable measure of damages \u2026 \u2009.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Oldenkott v. American Electric, Inc.<\/span>\u00a0(1971) 14 Cal.App.3d 198, 204 [92 Cal.Rptr. 127].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe trial court correctly found that defendants wrongfully terminated the employment contract and that the measure of damages was the difference between the amount Silva would have received under the contract and that amount which Silva actually received from his other employment.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Silva v. McCoy<\/span>\u00a0(1968) 259 Cal.App.2d 256, 260 [66 Cal.Rptr. 364].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe plaintiff has the burden of proving his damage. The law is settled that he has the duty of minimizing that damage. While the contract wages are prima facie [evidence of] his damage, his actual damage is the amount of money he was out of pocket by reason of the wrongful discharge.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Erler v. Five Points Motors, Inc., supra,<\/span>\u00a0249 Cal.App.2d at pp. 567\u2013568.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe burden of proof is on the party whose breach caused damage, to establish matters relied on to mitigate damage.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Steelduct Co. v.
