SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>Federal title VII requires a plaintiff to demonstrate that the employer refused to adopt the alternative employment practice (see\u00a042 U.S.C. \u00a7\u20092000e-2(K)(1)(A)(ii)). There are no published court opinions determining if a similar requirement exists under California law.<\/p>\n<p>This instruction must be given if defendant asserts the defense of business necessity to a disparate impact employment discrimination claim. (See\u00a0CACI No.\u20022503,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Affirmative Defense\u2014Business Necessity\/Job Relatedness<\/span>.) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Justification for Disparate Impact.\u00a0Cal. Code Regs., tit. 2, \u00a7\u200911010(b).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Disparate Impact Under Federal Law.\u00a042 U.S.C. \u00a7\u20092000e-2(k)(1)(A).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018The test [of the business necessity defense] is whether there exists an overriding legitimate business purpose such that the practice is necessary to the safe and efficient operation of the business. Thus, the business purpose must be sufficiently compelling to override any [discriminatory] impact; the challenged practice must effectively carry out the business purpose it is alleged to serve; and there must be available no acceptable alternative policies or practices which would better accomplish the business purpose advanced, or accomplish it equally well with a lesser differential [discriminatory] impact.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">City and County of San Francisco v. Fair Employment and Housing Com.<\/span>\u00a0(1987) 191 Cal.App.3d 976, 989\u2013990 [236 Cal.Rptr. 716].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he standards established by the FEHC for evaluating a facially neutral selection criterion which has a discriminatory impact on a protected group are identical to federal standards under Title VII.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">City and County of San Francisco, supra,<\/span>\u00a0191 Cal.App.3d at p. 986.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIf an employer does then meet the burden of proving that its tests are \u2018job related,\u2019 it remains open to the complaining party to show that other tests or selection devices, without a similarly undesirable [discriminatory] effect, would also serve the employer\u2019s legitimate interest in \u2018efficient and trustworthy workmanship.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Albemarle Paper Co. v.
