(See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Atkins v. City of Los Angeles<\/span>\u00a0(2017) 8 Cal.App.5th 696, 733 [214 Cal.Rptr.3d 113].)<\/p>\n<p>For an instruction in the religious creed context, see\u00a0CACI No. 2561,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Religious Creed Discrimination\u2014Reasonable Accommodation\u2014Affirmative Defense\u2014Undue Hardship<\/span>. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Employer Duty to Provide Reasonable Accommodation.\u00a0Government Code section 12940(m).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cUndue Hardship\u201d Defined.\u00a0Government Code section 12926(u).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018Undue hardship\u2019 means \u2018an action requiring significant difficulty or expense, when considered in light of the following factors: [\u00b6] (1) The nature and cost of the accommodation needed. [\u00b6] (2) The overall financial resources of the facilities involved in the provision of the reasonable accommodations, the number of persons employed at the facility, and the effect on expenses and resources or the impact otherwise of these accommodations upon the operation of the facility. [\u00b6] (3) The overall financial resources of the covered entity, the overall size of the business of a covered entity with respect to the number of employees, and the number, type, and location of its facilities. [\u00b6] (4) The type of operations, including the composition, structure, and functions of the workforce of the entity. [\u00b6] (5) The geographic separateness or administrative or fiscal relationship of the facility or facilities.\u2019 (\u00a7\u200912926, subd. (u).) \u2018\u2009\u201cWhether a particular accommodation will impose an undue hardship for a particular employer is determined on a case by case basis\u201d\u2009\u2019 and \u2018is a multi-faceted, fact-intensive inquiry.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Atkins, supra<\/span>, 8 Cal.App.5th at p. 733.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[U]nder California law and the instructions provided to the jury, an employer must do more than simply assert that it had economic reasons to reject a plaintiff\u2019s proposed reassignment to demonstrate undue hardship.
