Revoked December 2012; Restored and Revised June 2013; Revised November 2019, May 2020, May 2021 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>For religious beliefs and observances, the statute requires the employer (or other covered entity) to demonstrate that the employer explored certain means of accommodating the plaintiff, including two specific possibilities: (1) excusing the plaintiff from duties that conflict with the plaintiff\u2019s religious belief or observance or (2) permitting those duties to be performed at another time or by another person. (Gov. Code, \u00a7\u200912940(<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">l<\/span>)(1).) If there is evidence of another reasonable alternative accommodation, include it as a third means of accommodating the plaintiff. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Religious Accommodation Required Under Fair Employment and Housing Act.\u00a0Government Code section 12940(<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">l<\/span>)(1).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cUndue Hardship\u201d Defined.\u00a0Government Code section 12926(u).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIf the employee proves a prima facie case and the employer fails to initiate an accommodation for the religious practices, the burden is then on the employer to prove it will incur an undue hardship if it accommodates that belief. \u2018[T]he extent of undue hardship on the employer\u2019s business is at issue only where the employer claims that it is unable to offer any reasonable accommodation without such hardship.\u2019 \u2026\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Soldinger v. Northwest Airlines, Inc.<\/span>\u00a0(1996) 51 Cal.App.4th 345, 371 [58 Cal.Rptr.2d 747], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIt would be anomalous to conclude that by \u2018reasonable accommodation\u2019 Congress meant that an employer must deny the shift and job preference of some employees, as well as deprive them of their contractual rights, in order to accommodate or prefer the religious needs of others, and we conclude that Title VII does not require an employer to go that far. [\u00b6] \u2026 [\u00b6] Alternatively, the Court of Appeals suggested that [the employer] could have replaced [plaintiff] on his Saturday shift with other employees through the payment of premium wages\u2009\u2026\u2009. To require [the employer] to bear more than a de minimus cost \u2026 is an undue hardship. Like abandonment of the seniority system, to require [the employer] to bear additional costs when no such costs are incurred to give other employees the days off that they want would involve unequal treatment of employees on the basis of their religion.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">TWA v.
