To establish this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify defendant\u2019s source of authority to provide housing, e.g., owner<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] of [a\/an] [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify nature of housing at issue, e.g., apartment building<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [sought to rent\/was living in\/[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify<\/span>\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">other efforts to obtain housing<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]] the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">e.g., apartment<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] had [a history of having] [a] [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">e.g., physical disability<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [that limited [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert major life activity<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">4.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] knew of, or should have known of, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s disability;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">5.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That in order to afford [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] an equal opportunity to use and enjoy the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">e.g., apartment<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">], it was necessary to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify accommodation required<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">6.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That it was reasonable to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify accommodation<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">7.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] refused to make this accommodation. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New May 2017; Under the Fair Employment and Housing Act, \u201cdiscrimination\u201d includes the refusal to make reasonable accommodations in rules, policies, practices, or services when these accommodations may be necessary to afford a disabled person equal opportunity to use and enjoy a dwelling. (Gov. Code, \u00a7\u200912927(c)(1).)<\/p>\n<p>In the introductory paragraph, select a term to describe the source of the plaintiff\u2019s limitations. It may be a statutory term such as \u201cphysical disability,\u201d\u2009\u201cmental disability,\u201d or \u201cmedical condition.\u201d (See\u00a0Gov. Code, \u00a7\u200912940(a).) Or it may be a general term such as \u201ccondition,\u201d\u2009\u201cdisease,\u201d or \u201cdisorder.\u201d Or it may be a specific health condition such as \u201cdiabetes.\u201d Use the term in element 3.<\/p>\n<p>In element 2, if the plaintiff encountered a barrier before actually submitting an application, such as discovering a policy that would make it impossible to live in the unit, specify what the plaintiff did to obtain the housing.<\/p>\n<p>In element 3, select the bracketed language on \u201chistory\u201d of disability if the claim of discrimination is based on a history of disability rather than a current actual disability.<\/p>\n<p>Modify element 3 if the plaintiff was not actually disabled or had a history of disability, but alleges denial of accommodation because the plaintiff was perceived to be disabled or associated with someone who has, or is perceived to have, a disability. (See\u00a0Gov. Code, \u00a7\u200912926(o); see also\u00a0Gov. Code, \u00a7\u200912926(j)(4),\u00a0(m)(4)\u00a0[mental and physical disability include being regarded or treated as disabled by the employer].)<\/p>\n<p>In element 5, explain the accommodation in rules, policies, practices that is alleged to be needed. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Discrimination Defined Regarding Housing Disability Accommodations.\u00a0Government Code section 12927(c)(1).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cDisability\u201d Defined for Housing Discrimination.\u00a0Government Code section 12955.3.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cHousing\u201d Defined.\u00a0Government Code section 12927(d).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018FEHA in the housing area is thus intended to conform to the general requirements of federal law in the area and may provide greater protection against discrimination.\u2019 In other words, the FHA provides a minimum level of protection that FEHA may exceed. Courts often look to cases construing the FHA, the Rehabilitation Act of 1973, and the Americans with Disabilities Act of 1990 when interpreting FEHA.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Auburn Woods I Homeowners Assn. v. Fair Employment &amp; Housing Com.<\/span>\u00a0(2004) 121 Cal.App.4th 1578, 1591 [18 Cal.Rptr.3d 669], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he basic principles applicable in employment cases should also apply in the housing context.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Brown v. Smith<\/span>\u00a0(1997) 55 Cal.App.4th 767, 782 [64 Cal.Rptr.2d 301].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn order to establish discrimination based on a refusal to provide reasonable accommodations, a party must establish that he or she (1) suffers from a disability as defined in FEHA, (2) the discriminating party knew of, or should have known of, the disability, (3) accommodation is necessary to afford an equal opportunity to use and enjoy the dwelling, and (4) the discriminating party refused to make this accommodation.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Auburn Woods I Homeowners Assn., supra<\/span>, 121 Cal.App.4th at p.1592.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cFEHA prohibits, as unlawful discrimination, a \u2018refusal to make reasonable accommodations in rules, policies, practices, or services when these accommodations may be necessary to afford a disabled person equal opportunity to use and enjoy a dwelling.\u2019\u2009\u2018In order to establish discrimination based on a refusal to provide reasonable accommodations, a party must establish that he or she (1) suffers from a disability as defined in FEHA, (2) the discriminating party knew of, or should have known of, the disability, (3) accommodation is necessary to afford an equal opportunity to use and enjoy the dwelling, and (4) the discriminating party refused to make this accommodation.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Roman v. BRE Properties, Inc.<\/span>\u00a0(2015) 237 Cal.App.4th 1040, 1051 [188 Cal.Rptr.3d 537], internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWe note that, currently, section 12955.3 explicitly states that \u2018disability\u2019 includes \u2018any physical or mental disability as defined in Section 12926.\u2019 That statute in turn defines \u2018mental disability\u2019 to include \u201cany mental or psychological disorder or condition \u2026 that limits a major life activity\u2019, that is, \u2018makes the achievement of the major life activity difficult.\u2019\u2009\u2018Major life activities\u2019 is to be broadly construed, and includes \u2018physical, mental, and social activities and working.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Auburn Woods I Homeowners Assn., supra<\/span>, 121 Cal.App.4th at p. 1592, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018If a landlord is skeptical of a tenant\u2019s alleged disability or the landlord\u2019s ability to provide an accommodation, it is incumbent upon the landlord to request documentation or open a dialogue.\u2019 This obligation to \u2018open a dialogue\u2019 with a party requesting a reasonable accommodation is part of an interactive process in which each party seeks and shares information.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Auburn Woods I Homeowners Assn., supra<\/span>, 121 Cal.App.4th at p. 1598, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThis evidence established the requisite causal link between the [defendant]\u2019s no-pets policy and the interference with the [plaintiffs]\u2019 use and enjoyment of their condominium.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Auburn Woods I Homeowners Assn., supra<\/span>, 121 Cal.App.4th at p. 1593.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWhen the reasons for a delay in offering a reasonable accommodation are subject to dispute, the matter is left for the trier of fact to resolve. The administrative law judge properly characterized this lengthy delay as a refusal to provide reasonable accommodation.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Auburn Woods I Homeowners Assn., supra<\/span>, 121 Cal.App.4th at p. 1599, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWe reiterate that the FEHC did not rule that companion pets are always a reasonable accommodation for individuals with mental disabilities.
