Compensation\u2014Proof of Overtime Hours Worked<\/h2>\n<hr \/>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">State law requires California employers to keep payroll records showing the hours worked by and wages paid to employees.<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">If [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] did not keep accurate records of the hours worked by [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">], then [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] may prove the number of overtime hours worked by making a reasonable estimate of those hours.<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">In determining the amount of overtime hours worked, you may consider [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s estimate of the number of overtime hours worked and any evidence presented by [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s estimate is unreasonable. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>This instruction is intended for use when a nonexempt employee plaintiff is unable to provide evidence of the precise number of hours worked because of the employer\u2019s failure to keep accurate payroll records. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Hernandez v. Mendoza<\/span>\u00a0(1988) 199 Cal.App.3d 721, 727\u2013728 [245 Cal.Rptr. 36].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Right of Action for Unpaid Overtime.\u00a0Labor Code section 1194(a).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Employer Duty to Keep Payroll Records.\u00a0Labor Code section 1174(d).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[W]here the employer has failed to keep records required by statute, the consequences for such failure should fall on the employer, not the employee. In such a situation, imprecise evidence by the employee can provide a sufficient basis for damages.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Furry v. East Bay Publishing, LLC<\/span>\u00a0(2018) 30 Cal.App.5th 1072, 1079 [242 Cal.Rptr.3d 144].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[W]here the employer has failed to keep records required by statute, the consequences for such failure should fall on the employer, not the employee. In such a situation, imprecise evidence by the employee can provide a sufficient basis for damages.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Furry v. East Bay Publishing, LLC<\/span>\u00a0(2018) 30 Cal.App.5th 1072, 1079 [242 Cal.Rptr.3d 144].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAlthough the employee has the burden of proving that he performed work for which he was not compensated, public policy prohibits making that burden an impossible hurdle for the employee. \u2026 \u2018In such situation \u2026 an employee has carried out his burden if he proves that he has in fact performed work for which he was improperly compensated and if he produces sufficient evidence to show the amount and extent of that work as a matter of just and reasonable inference. The burden then shifts to the employer to come forward with evidence of the precise amount of work performed or with evidence to negative the reasonableness of the inference to be drawn from the employee\u2019s evidence. If the employer fails to produce such evidence, the court may then award damages to the employee, even though the result be only approximate.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Hernandez, supra,<\/span>\u00a0199 Cal.App.3d at p. 727, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cOnce an employee shows that he performed work for which he was not paid, the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">fact<\/span>\u00a0of damage is certain; the only uncertainty is the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">amount<\/span>\u00a0of damage.
