data-housestyle=\"EMPHASIS_bf\">] claims that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify bona fide factor other than sex, race, or ethnicity<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] is a legitimate factor other than [sex\/race\/ethnicity] that justifies paying [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of data-housestyle=\"EMPHASIS_bf\">]\u2019s position; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That the factor is consistent with a business necessity.<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">A \u201cbusiness necessity\u201d means an overriding legitimate business purpose such that the factor effectively fulfills the business purpose it is supposed to serve.<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">This defense does not apply, however, if [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] proves that an alternative business practice exists that would serve the same business purpose without producing the pay data-housestyle=\"EMPHASIS_it\">Affirmative Defense\u2014Different Pay Justified,<\/span>\u00a0if factor d of element 1 of\u00a0CACI No. 2741\u00a0is chosen: a bona fide factor other than sex, race, or ethnicity, such as education, training, or experience. This factor applies only if the employer demonstrates that the factor is not based on or derived from a sex, race, or ethnicity-based differential in compensation, is job-related with respect to the position in question, and is consistent with a business necessity. \u201cBusiness necessity\u201d means an overriding legitimate business purpose such that the factor effectively fulfills the business purpose it is supposed to serve. This defense does not apply if the employee demonstrates that an alternative business practice exists that would serve the same business purpose without producing the wage differential.
