with [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify requirement under Labor Code or local ordinance, e.g., minimum wage requirements<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];]<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[or]<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[informed someone of that person\u2019s potential rights and remedies for [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s alleged [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify violation of Labor Code or local ordinance, e.g., failure to pay the minimum or in a manner not required or authorized by federal immigration law;]<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[or]<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[filed or threatened to file a false [police report\/report or complaint with a state or local agency];]<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[or]<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[contacted or threatened to contact immigration authorities;]<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s conduct was for the purpose of, or with the intent of, retaliating against [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] for exercising SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>One who is the victim of an \u201cunfair immigration-related practice\u201d as defined, or that person\u2019s representative, may bring a civil action for equitable relief and any damages or penalties. (Lab. Code, \u00a7\u20091019(a).) While most commonly this claim would be brought by an employee against an employer, the statute prohibits unfair immigration-related practices by \u201can employer or any other person\u201d against \u201can employee or other person.\u201d (Lab. Code, \u00a7\u20091019(d)(1).) Therefore, the statute does not require an employment relationship between the parties.<\/p>\n<p>Engaging in an unfair immigration-related practice against a person within 90 days of the person\u2019s exercise of protected rights raises a rebuttable presumption that the defendant did so in retaliation for the plaintiff\u2019s exercise of those rights. (Lab. Code, \u00a7\u20091019(c).) The statute does not specify whether the presumption is one affecting only the burden of producing evidence (see\u00a0Evid. Code, \u00a7\u00a7\u2009603,\u00a0604) or one affecting the burden of proof. (See\u00a0Evid. Code, \u00a7\u2009605.) If the statute implements a public policy against the use of immigration-related coercion to deter workers from exercising their rights under the Labor Code, its presumption would affect the burden of proof. (See\u00a0Evid. Code, \u00a7\u2009605.) The last optional paragraph of the instruction may then be given if applicable on its facts. If, however, the presumption affects only the burden of producing evidence, it ceases to exist when the defendant produces evidence rebutting the presumption, such as a reason for the action other than retaliation. (Evid. Code, \u00a7\u2009604.)
