href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>This instruction presents the so-called\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fermino<\/span>\u00a0exception to the exclusivity of workers\u2019 compensation. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fermino v. Fedco, Inc.<\/span>\u00a0(1994) 7 Cal.4th 701 [30 Cal.Rptr.2d 18, 872 P.2d 559].) Its purpose is to rebut element 3 of\u00a0CACI No. 2800,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Employer\u2019s Affirmative Defense\u2014Injury Covered by Workers\u2019 Compensation.<\/span>\u00a0Per element 3, the injury falls within the exclusive remedy of workers\u2019 compensation if it occurred while the employee was performing the work that the employee was required to do. The\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fermino<\/span>\u00a0exception changes the focus from what the employee was doing when injured to what the employer was doing that may have caused the injury. The exclusive remedy does not apply if the employer caused the injury through conduct unrelated to the work. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Id.,<\/span>\u00a07 Cal.4th at p. 717.) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[N]ormal employer actions causing injury would not fall outside the scope of the exclusivity rule merely by attributing to the employer a sinister intention. Conversely, \u2026 actions by employers that have no proper place in the employment relationship may not be made into a \u2018normal\u2019 part of the employment relationship merely by means of artful terminology. Indeed, virtually any action by an employer can be characterized as a \u2018normal part of employment\u2019 if raised to the proper level of abstraction.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fermino, supra,<\/span>\u00a07 Cal.4th at p. 717 [30 Cal.Rptr.2d 18, 872 P.2d 559].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[C]ertain types of injurious employer misconduct remain outside this bargain. There are some instances in which, although the injury arose in the course of employment, the employer engaging in that conduct \u2018\u2009\u201cstepped out of [its] proper role[]\u201d\u2009\u2019 or engaged in conduct of \u2018\u2009\u201cquestionable relationship to the employment.\u201d\u2009\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fermino, supra,<\/span>\u00a07 Cal.App.4th at p. 708.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[CACI No. 2800] was correctly given, however, because the evidence was able to support a finding that the work was not a contributing cause of the injury. [\u00b6] The jury could properly make this finding by applying special instruction No. 5, the instruction stating that an employer\u2019s conduct falls outside the workers\u2019 compensation scheme when an employer steps outside of its proper role or engages in conduct unrelated to the employment. This instruction stated the doctrine of\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fermino<\/span>\u00a0correctly. If the jury found that carrying out the mock robbery was not within the employer\u2019s proper role, it could also find that unwittingly participating in the mock robbery as a victim was not part of the employee\u2019s work.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Lee v. West Kern Water Dist.<\/span>\u00a0(2016) 5 Cal.App.5th 606, 628\u2013629 [210 Cal.Rptr.3d 362].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe jury could properly find the injury did not arise out of the employee\u2019s work because it was caused by such employer action and therefore the conditions of compensation did not exist. To hold that the jury must first find the injury to be within the conditions of compensation and then find it also to be within the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fermino<\/span>\u00a0exception, instead of simply finding that the conditions of compensation were not met in the first place in light of\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fermino,<\/span>\u00a0would be elevating form over substance.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Lee, supra,<\/span>\u00a05 Cal.App.5th at p. 629.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he exclusive remedy provisions are not applicable under certain circumstances, sometimes variously identified as \u2018conduct where the employer or insurer stepped out of their proper roles\u2019 [citations], or \u2018conduct of an employer having a \u201cquestionable\u201d relationship to the employment\u2019 [citations], but which may be essentially defined as not stemming from a risk reasonably encompassed within the compensation bargain.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Light v.
