To succeed, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove both of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff\/decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was negligent; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff\/decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s negligence was a cause of [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [harm\/death].<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Name of plaintiff\/decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s negligence, if any, was a cause of [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] own [harm\/death] if it played any part, no matter how small, in bringing about [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [harm\/death], even if other factors also contributed to [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [harm\/death].<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">If you decide that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was negligent but also decide that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff\/decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s negligence contributed to the harm, then you must determine the percentage of negligence that you attribute to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff\/decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003; Revised December 2009 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Directions for Use<\/span><\/h2>\n<div id=\"TRNotes_n_2\">\n<p>This instruction does not apply if the claim is based on a violation of the Federal Safety Appliance Act or the Boiler Inspection Act.<\/p>\n<p>For a definition of the term \u201cnegligence,\u201d see\u00a0CACI No. 401,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Basic Standard of Care<\/span>. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Sources and Authority<\/span><\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Contributory Negligence Under the FELA. Title\u00a045 United States Code section 53.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe FELA provides that defense of contributory negligence is not available to an employer to defeat an employee\u2019s claim for injury, but only to diminish the amount of damages in proportion to the amount of negligence attributable to the employee. Southern Pacific Co.<\/span>\u00a0(1968) 260 Cal.App.2d 757, 763 [67 Cal.Rptr. 428], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cNeither assumption of the risk nor the contributory negligence of the employee bars recovery, if the injury was at least in part the result of the employer\u2019s negligence.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fair v. BNSF Railway Co.<\/span>\u00a0(2015) 238 Cal.App.4th 269, 276 [189 Cal.Rptr.3d 150].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he same standard of causation applies to railroad negligence under Section 1 as to plaintiff contributory negligence under Section 3.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Norfolk Southern Ry. v. Sorrell<\/span>\u00a0(2007) 549 U.S. 158, 171 [127 S.Ct. 799, 166 L.Ed.2d 638].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cUnder this statute the test of a jury case is simply whether the proofs justify with reason the conclusion that employer negligence played any part, even the slightest, in producing the injury or death for which damages are sought.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Rogers v. Missouri Pacific Railroad Co.<\/span>\u00a0(1957) 352 U.S. 500, 506 [77 S.Ct. 443, 1 L.Ed.2d 493].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn sum, the understanding of\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Rogers<\/span>\u00a0we here affirm \u2018has been accepted as settled law for several decades.\u2019 \u2018Congress has had [more than 50] years in which it could have corrected our decision in [<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Rogers<\/span>] if it disagreed with it, and has not chosen to do so.\u2019 Countless judges have instructed countless juries in language drawn from\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Rogers<\/span>. To discard or restrict the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Rogers<\/span>\u00a0instruction now would ill serve the goals of \u2018stability\u2019 and \u2018predictability\u2019 that the doctrine of statutory stare decisis aims to ensure.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">CSX Transp., Inc. v. McBride<\/span>\u00a0(2011) 564 U.S. 685, 699 [131 S.Ct. 2630, 180 L.Ed.2d 637], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe common law concept of proximate cause \u2026 has not been adopted as the causation test in F.E.L.A. cases. Causation in an F.E.L.A. case exists even if there is a plurality of causes, including the negligence of the defendant or of a third person. The negligence of the employer need not be the sole cause or even a substantial cause of the ensuing injury.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Parker v.
