incident.<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Conduct is within the scope of employment if:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">(a)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">It is reasonably related to the kinds of tasks that the employee was hired to perform; or<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">(b)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">It is reasonably foreseeable in light of the employer\u2019s business or the employee\u2019s job responsibilities. SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cFELA\u2019s limitation of a railroad\u2019s liability to injuries occurring \u2018while [the person] is employed by\u2019 the railroad means that it must generally be determined whether the employee was injured while she was acting within the scope of her employment. \u2018Normally, whether an employee is acting within the scope of employment is a question to be resolved by the jury from all the surrounding circumstances,\u2019 for \u2018in negligence actions brought under the FELA, \u2026 the role of the jury is significantly greater \u2026 than in common law negligence actions \u2026\u2009.\u2019 Indeed, \u201c\u2009\u2018trial by jury is part of the remedy.\u2019\u2009\u201d\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Goldwater v. Metro-North Commuter Railroad<\/span>\u00a0(2d Cir. 1996) 101 F.3d 296, 298, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe scope of employment under FELA is broadly construed by the federal courts\u2014and has been for more than 80 years. In the seminal FELA case of\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Erie Railroad Company v. Winfield<\/span>\u00a0(1917) 244 U.S. 170 [37 S.Ct. 556, 61 L.Ed. 1057], the Supreme Court held that an employee who leaves the railroad carrier\u2019s yard \u2018at the close of his day\u2019s work\u2019 is engaged in a \u2018necessary incident of his day\u2019s work,\u2019 and thus is \u2018but discharging a duty of his employment.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Ponce v. Northeast Illinois Regional Commuter Railroad Corp.<\/span>\u00a0(N.D. Ill. 2000) 103 F.Supp.2d 1051, 1056, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cRailroad employment has been broadly interpreted to extend not only to acts required by the employer, but also to those acts necessarily incidental to the employment. [\u00b6] This circuit and others have nevertheless held that even \u2018given its most liberal interpretation, the Act cannot be extended to cover activities not necessarily incident to or an integral part of employment in interstate commerce. It obviously does not cover activities undertaken by an employee for a private purpose and having no causal relationship with his employment.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Feichko v. Denver &amp; Rio Grande Western Railroad Co.<\/span>\u00a0(10th Cir. 2000) 213 F.3d 586, 592, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Restatement Second of Agency, section 229, provides:<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(1)<\/span><span class=\"SS_ListItemContent\">To be within the scope of the employment, conduct must be of the same general nature as that authorized, or incidental to the conduct authorized.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(2)<\/span><span class=\"SS_ListItemContent\">In determining whether or not the conduct, although not authorized, is nevertheless so similar to or incidental to the conduct authorized as to be within the scope of employment, the following matters of fact are to be considered:<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(a)<\/span><span class=\"SS_ListItemContent\">whether or not the act is one commonly done by such servants;<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(b)<\/span><span class=\"SS_ListItemContent\">the time, place and purpose of the act;<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(c)<\/span><span class=\"SS_ListItemContent\">the previous relations between the master and the servant;<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(d)<\/span><span class=\"SS_ListItemContent\">the extent to which the business of the master is apportioned between different servants;<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(e)<\/span><span class=\"SS_ListItemContent\">whether or not the act is outside the enterprise of the master or, if within the enterprise, has not been entrusted to any servant;<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(f)<\/span><span class=\"SS_ListItemContent\">whether or not the master has reason to expect that such an act will be done;<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(g)<\/span><span class=\"SS_ListItemContent\">the similarity in quality of the act done to the act authorized;<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(h)<\/span><span class=\"SS_ListItemContent\">whether or not the instrumentality by which the harm is done has been furnished by the master to the servant;<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(i)<\/span><span class=\"SS_ListItemContent\">the extent of departure from the normal method of accomplishing an authorized result; and<\/span><\/p>\n<p><span class=\"SS_ListLabel\">(j)<\/span><span class=\"SS_ListItemContent\">whether or not the act is seriously criminal.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe\u00a0Restatement at \u00a7\u2009229\u00a0sets forth intelligent factors for a factfinder to consider in determining whether this has happened. We emphasize that no one factor is dispositive; establishing one or more factors is not equivalent to establishing scope of employment.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Wilson v. Chicago, Milwaukee, St. Paul &amp; Pacific Railroad Co.<\/span>\u00a0(7th Cir. 1988) 841 F.2d 1347, 1355.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[A]s a general rule, courts have held that an employee injured while commuting to and from work is not covered by FELA.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Ponce, supra,<\/span>\u00a0103 F.Supp.2d at p. 1057.)
