SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>This instruction sets forth a defendant\u2019s response to a plaintiff\u2019s claim of retaliation. See\u00a0CACI No. 3050,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Retaliation\u2014Essential Factual Elements<\/span>. The defendant bears the burden of proving the nonretaliatory reason for the allegedly retaliatory conduct. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Nieves v. Bartlett<\/span>\u00a0(2019) ___ U.S. ___ [139 S.Ct. 1715, 1725, 204 L.Ed.2d 1].<\/p>\n<p>In retaliatory arrest and prosecution cases, use this instruction only if the court has determined the absence of probable cause or that an exception to the no-probable-cause requirement applies because the plaintiff presented objective evidence that otherwise similarly situated individuals not engaged in the same sort of constitutionally protected activity were not arrested or prosecuted. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Nieves, supra,<\/span>\u00a0139 S.Ct. at p. 1727 [stating exception to no-probable-cause requirement when otherwise similarly situated individuals were not arrested for the same conduct].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[I]f the plaintiff establishes the absence of probable cause, \u2018then the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mt.
